Q: Hi, Will I get a labor ban for resigning during my probation period? I am under an unlimited contract for a private company in Abu Dhabi. Status amended on 10/01/2021. I passed a resignation on 08/06/2021. This is my 1st contract with them as my 2nd job in the UAE. My 1st job was in Dubai and I completed 1+ years with them.

Q: Hi, I went to the UAE in 2019 on a work visa along with my husband. During my medical fitness, they found scars on my lungs. I got a Quantiferon gold test done privately, however they didn`t give me a chance to discuss and I was asked to leave the country within a month`s time post a retina scan. Considering that I couldn`t stay in Dubai and didn`t have a job in hand because my employer was insisting on leaving UAE in 4-5 days else their trade license could get revoked, I came back and re-settled in my home country India. I came back to India and got all my tests done. I`ve never had TB - active or inactive. The lung scars are due to a completely unrelated condition called Sarcoidosis which is a non-communicable, auto-immune disease. I am getting now job offers from Dubai again. If I want to apply again and try and apply for a work visa again, would the process be given that there has also been a rejection once?

Q: Hi, I have an outstanding credit card amount of AED 22,000 unpaid since March 2019, which has now gone up to AED 38,000. Since Nov 2020, a third-party debt collection agency is behind me for this amount. Now the bank is directly negotiating for AED 18,000 in one shot payment. I am unable to pay this amount. Q: I entered into a limited-term contract with my employer in Feb 2021. I worked for 2 months and then I traveled to Mumbai for a family medical emergency (Covid). Now that the flights are suspended, I am stuck in Mumbai. I also resigned from the company since I have to stay back in Mumbai to take care of my house. My employer is asking for 45 days salary but I don`t have any money to pay him. What is the way out? I also offered him notice from Mumbai but he is refusing and not settling things as well. Can he put a ban on me? What are the legal implications if I don`t pay him?

Appealing a judgment by an employee while the period allowed for appeal has passed

Q: I have 14 months` salary pending from my previous employer. I filed a case in the Abu Dhabi labor court and received a judgment from the First Instance court for only 25% of the claimed amount. Due to a system issue, my service request for an appeal (made online) didn`t go through and I was finally able to lodge an appeal at the Enjaz center in Musaffah 6 days after the 15-day timeframe for labor case appeals. I have now received a trial note stating that I have forfeited the right to appeal. No reason is mentioned in the trial note. All my life savings are tied up with my previous company so I would really appreciate any help on how to move this forward and get the money that is owed to me. My previous employer has been manipulating WPS which may be why the amount was so low in the first place. Please respond!

س: السلام عليكم، انا مدير شركة خاصة ذات مسؤولية محدودة ولدي توكيل بإدارة المنشأة وإجراء المعاملات الإدارية مع البنوك والى آخره، كما لدي صلاحية التوقيع على الشيكات. في آخر أشهر، دخلت الشركة في خسائر تجارية معينة. صاحب الشركة سافر لبلده بحجة قضاء إجازة والعودة فكنت مسؤولاً عن إعطاء شيكات لشركتين مختلفتين لكن بعد انقضاء الوقت المحدد لم يعد المالك صاحب الشركة والشيكات ارتجعت بحكم أنه لا يوجد رصيد في البنك. المشكلة انا صاحب الشركة في الوقت الحالي لا يجيب على الرسائل ولا توجد طريقة أخرى للتواصل معه و لنا، موظفي الشركة، رواتب متأخرة والتزامات لم تسدد، فما الحكم القانوني عليّ بعد إمضاء الشيكات؟ علمًا بأن اسمي غير مذكور في الرخصة التجارية. أنا مدير إداري. وشكرًا مسبقًا!

Q: The execution court executed the seizure of the company`s assets and closure for public auction. But later found out that there was already similar execution from another case done by a company that has a payment dispute with my employer a year ago. My employer is a construction company with many disputes from Labour and Arbitration cases. The court responded that I will be part of the court order for seizure and public auction of the company. 1. What will I do next? 2. What are my options since the first execution order for seizure of assets was a year ago and until now the company is still in business? 3. Can the buyer add to an MOU a clause to avoid any unforeseen incumbrances?

Q: Hello, I like initial advice from a legal professional before proceeding with the sale of a shop. The buyer agrees to pay a deposit and sign an MOU but wanted to add a line in the MOU that if anything we hide or not disclose which he finds later - he will eligible for a deposit refund and a penalty from us. Now we say no to this open-ended clause right away. We provided a credit report, court letter, accounts everything to his due diligence representing a company but he still wants to add this line to make it risk-free.
