Legal authorities of company partners in the absence of one partner

Q: We have a restaurant partnership in Deira, Dubai. My share is 16%, the second partner`s share is 21% and the third partner`s share is 12%. I have not applied for the Emirates ID, I am currently in Pakistan. Can my partners sell or lease that restaurant without my permission? Regards

Travel ban and arrest warrant check after closing a loan

Q: Hello, Can someone tell me what a travel ban is connected to? Is it your passport number? I understand I have an open case in Dubai for a loan (that`s actually paid now) and I`m now outside the UAE, so have no Emirates ID card or number. If I attempted to get back in the country whilst that case is still open, would I be pulled up on my passport number? What if the passport number they have on record is expired and you have a new number, can that case still be connected to you? If I knew it was safe I would be happy to return and go to the police station myself to close it. I have the details from the bank.

Civil action for recovery of dues from a company

Q: Hello We have a receivable of AED 38,000.00 from a company in Dubai. The amount is due from July 2017 and all our attempts to collect the money have failed. Is there any chance to proceed legally to collect this amount and also to put a travel ban on the owners of the company? What will be estimated cost for the same?

Payment of bounced cheque fine and release from custody

Q: Good Afternoon, My relative had been in court trial today for a bounced cheque wherein the judgement is a fine payment of AED 10,000. He has sufficient money with him and can pay this fine immediately, however, the court is not clarifying when the fine can be paid and when he will be released. At the moment, he is being held at the Dubai Courts and we are still unsure when he will be able to get out. I am aware that the Courts close at 2 PM. Does it also mean he would not be able to be released today? Thank you

Refund of the reservation fee paid to the developer

Q: Hi, I had booked two villas with a developer and paid them the booking fee of 40000, 20000 each. After which, due to certain circumstances, I had to drop the idea to proceed ahead with the purchase. Checking with the developer`s sales representative, he said it is not possible to get a refund. What are my chances to get a refund in the above case? I did not sign any document, just have the receipts of 40000 paid on different dates.

Closing a company and cancellation of partners visas

Q: Hi. Kindly advise regarding: (1) Closing a professional civil company (management consultancy) in Dubai with 4 partners + 1 local agent. There are 4 partners (all family members) who are out of the UAE. 2 partners have investor visas & 2 have partner visas. 3 visas have expired during July-Sept 18 and 1 Investor visa expiring 17/11 as being out of the country for 6 months+. Online at www.gdrfa.ae on logging in, the 3 expired visas are showing `Inactive`. Does it mean visas are automatically cancelled & they can come on visit OR visas have to be physically cancelled at the immigration dept? The company has no assets/liability. We want to close the company. The company`s labour est card is already cancelled. (2) Effect of a partner`s personal credit cards` liability on the company as a he is a partner. In the above company, 2 partners have credit card dues. Is there an impact on 2 aged partners coming back to the UAE if the banks file cases & secure order on attaching the defaulting partners share in above company? (There is no business/assets). Can 2 aged partners be asked to submit the company a/cs?

Working with a company without a labour card

Q: Hi Anita, I was employed with my current company in April. I received the offer letter and began working at the company on April 30th. Since then, I have been asking about my labour card (I am on my father`s visa) and the company has been very vague. As of September 30th, I completed my probation as well having worked at the company for six months. I have pay slips showing that the company has been paying me a salary. I have an official email with correspondence from the company owners and with other partners and suppliers. so I have a lot of physical evidence that I have been working here. My question is, what can I do legally to ensure they offer me a labour card? I want to know my legal rights and their consequences if they fail to follow through with this. Appreciate your feedback. Claiming money paid for closing a company after failing to deliver

Q: I am from India. We had a company registered in the UAE and we were willing to discontinue it. So we paid some amount to a local person in Dubai in order to complete all formalities of closure. There was not any formal agreement, but there was an email communication to complete it. But in spite of the passage of one & half years, he has neither closed my company nor paid me back that amount. Now, he is not responding to me on email. Please advise me about my options.
