Holding and presenting PDC by the landlord after leaving the flat

Q: Good morning, Seeking advice. Our landlord filed a financial case against our so called bounced cheque. However, we left the old flat, and they are still holding our PDC and kept on sending it to the bank. Hoping you can help us.

س: مرحبًا، أدخلنا الوالدة من حوالي شهر لأحد المشافي الخاصة من أجل علاج ورم في الدماغ والورم كان في الجهة اليمنى بعيدًا عن جذع الدماغ. أخبرنا الطبيب أنه سيتمكن من إزالة الأورام وأن حالتها الصحية جيدة وتسمح بإجراء جراحة لها وهذا الكلام مثبت من خلال التقارير ولم يخبرنا شفهيًا أو كتابيًا أنه يمكن أن تدخل في غيبوبة. أجرى الطبيب الجراحة التي استغرقت 11 ساعة في حين كان مقرر لها 8 ساعات. بعد خروج الطبيب أبلغنا أن دماغها كان يعاني من الضغط وأنهم أغلقوا الجمجمة من جديد. حاول الأطباء اليوم الذي يليه أن يوقظونها ولم تستيقظ. بعد 3 أيام جاء الطبيب ليقول إن حالتها حرجة وهي بحاجة إلى عملية عاجلة لإعادة إزالة عظم من الجمجمة (التي أغلقها قبل 3 أيام) وقال أنه يجب أن تتم العملية اليوم ولكن غرفة العمليات ممتلئة فتأجلت لليوم الذي يليه؛ أي بعد 4 أيام من العملية الأولى. وبعد العملية الثانية، قال إن الوضع جيد وهو متأكد أنها ستستفيق وبعد اليوم التالي ذهب في إجازة لمدة 15 يومًا. بعد اليوم الذي سافر فيه، أتانا طبيب آخر ليخبرنا أن فرصة إفاقتها ضعيفة جدًا وهي في غيبوبة منذ شهر. ماذا يمكن أن نفعل في هذه الحالة؟

أعطيت شيكات لشخص باعتبارها ضمانًا لصفقة لم تتم. كيف أستردها؟

س: حررت ٣ شيكات (كل شيك بقيمة مليون ومائة ألف درهم) من الشركة باسم شخص وسيط كضمان، حيث وعدني بتدبير عقد مجزِ من جهة كبيرة - الوسيط لديه معارف ولا يعمل بالجهة. لم يتحقق العمل ولم يتحصل لدي المبلغ أصلاً فلم أستفد منه شيئًا. أخاف أن يقدم الشيكات للمطالبة القانونية. ليس لديه دليل على أنه قام بالعمل وأتمَّ الصفقة (لا عقد ولا فواتير ولا اتفاقية)؛ مجرد الشيكات بيده. كيف يمكنني إنهاء الأمر؟ هل أطالبه بالشيكات؟ أخاف أن يثور ويفعل ما أخشاه! وماذا إن قدم بلاغًا بهم؟ هل أكون ملزمًا؟ ما العقوبة الجزائية والمدنية لعدم السداد؟ أنا مرتبك صراحة ولا أعرف كيف أتصرف!

My questions are: Does he have the right to throw me out of the house while we are still legally married? I understand that he should be the one to provide accommodation, feeding, and other expenses. هل يمكن الحصول على المستحقات التي حجزها البنك بسبب مديونية؟

س: فُصلت من العمل تعسفيًا وحُجزت كل مستحقات نهاية أكثر من سبع سنوات من الخدمة بالإضافة إلى مبلغ التعويض عن الفصل التعسفي وأيضًا مبلغ التعويض عن مهلة الإنذار وكل المستحقات الأخرى؛ مثل راتب آخر شهر في العمل وبدل تذكرة السفر وكذلك بدل ما تبقى من أيام الإجازات المستحقة، وذلك بغرض سداد ما تبقى من مديونية مستحقة للبنك. طلبت من البنك أن يُفرِج عن البدلات المستحقة ويحجز مستحقات نهاية الخدمة فقط وأقوم بسداد بقية المديونية على نفس الأقساط المتفق عليها. هل يمكن أن أحصل على تلك البدلات قانونيًا؟ علمًا بأنني كنت أعمل لدى نفس البنك وفُصلت تعسفيًا.

Can the tenant exit the lease contract early after losing access to gas?

Q: There was a gas pipe explosion in our building and the whole floor is unhabitable. So we are located on another floor, gas usage was cut and had to rely on electric plates which takes longer time to cook and there is the fear of fire if left unattended. Gas will be reinstalled after 3 months and we wish to terminate the contract early because we cannot use the gas which is one of the facilities we agreed for in the contract and we feel unsafe in the building because every now and then the alarm goes on. They gave us an option to move to their other buildings but will even be farther from work plus the transportation costs will increase. Do we have to pay penalty charges for a situation that is not our doing? We are already having heart palpitations whenever there’s an alarm?

Claiming compensation from the landlord for failing to fulfill obligations

Q: I moved to an apartment in July 2018 and the landlord was outside of Dubai. Being a foreigner, he promised to complete all documentation soon and he cashed out my cheques. Then he stated that the apartment was registered on his son (a minor) and doesn`t have the necessary documents and he will complete when he comes to Dubai. He came 9 months after I moved in and that costed me to pay AED 12,100 proven fine for late renewal of my maid’s visa (Ejari is the landlord`s responsibility). As per the contract, the Building Management deactivated access cards including the parking during my stay, saying the landlord failed to pay the service fee. This was the case for 100 days. All failures were acknowledged by the landlord via emails. When moving out (July 2019) his agent inspected the apartment. They promised to provide a list of deductions in few days which happened with 53 days delay and failed to present invoices and return deposit balance so far (80 days delay). The deduction is a round figure (suspicious). Please let me know if you can assist and tell me about the cost.

Stopping the payment of a cheque for breaching obligations

Q: I gave 12 guarantee cheques against salon rent. The first month, they deposit the cheque without information and collected the amount. The second time, we gave cash by hand and collected the cheque. But before the third time, we asked for an agreement for the salon. They said later. So when we realized they cannot give the agreement, we said we are leaving the salon and requested all cheques since there is no agreement. They refused and deposited and collected the amount. So I asked again and again and they are not ready to return the cheque and we already stopped work in the salon. Later, we reported in the police station the loss of the cheque and we asked the bank to stop the payment. But now they made a case against me for 20000 for bounced cheque due to stopping the payment of the cheque. How can I get a solution for this case?
