Canceling a property rental contract before the designated move-in date

Q: Is it possible to cancel a property rental contract before the designated move-in date that has been signed already? What are the rights of the landlord on my cheques that have been given to him already? Will I have to pay any fees even though I have not received the keys to the place yet, and I am also unable to move due to the COVID-19 lockdown?

Resignation in the probation period during Corona-virus pandemic

Q: Hello, I would like to ask you a few questions regarding my resignation. I started to work as a filing clerk in a company in Dubai from 2nd Nov. 2019. I am in my probation period now (6 months). I am planning to resign on 2nd April (5 months) so I can serve another 30 days. After 30 days, it will be exactly 6 months. My contract is unlimited. 1. Can I resign without any problem? 2. Because of Coronavirus, I will not most likely work all April. My employer will take it as a paid vacation. Will I also get paid for April (my last month) since I already gave him my resignation? 3. Legal status of an employee threatened to be terminated by the employer

Q: Hello, My employer has said they will terminate me due to me voicing out my concerns during the COVID-19 pandemic as I found them following unsafe hygiene practices. I finish my probation on the 8th of April 2020, but they haven`t given me any letters stating so but want me to start serving the notice period. What are my rights here?

Deducting housing allowance from end of service gratuity upon resignation

Q: I have resigned from my current job and my last day is May 9th after a notice period of 2 months. I was employed for 4 years. My employer has paid me a full year housing allowance and would like to deduct the remaining months from my end of service. Is this allowed? I have not been made aware that the amount would be deducted in case I resign. Also, I am entitled to 30 days of leave per year. Since I have resigned, they have applied a pro-rata for this year for the end of service calculation. Is this allowed? Shouldn`t I be compensated for the 30 days that I have not taken? Thank you!

Q: I want to early terminate my tenancy contract of one of my nurseries in JLT (retail unit) as the business is completely shut since March. I am unable to contact my landlord who is a Chinese national; he does not reply to email or call and may not be in Dubai. The final cheque is due 01 May 2020, what should I do?

Settling an outstanding loan and getting back to the UAE

Q: Dear Madam, Good morning to you, I left the UAE last year in Feb 2019 on a leave to bring funds to pay some cards` payments, but unfortunately, I am not able to arrange it and I was depressed because of this matter. Q: Dear sir, I am an employer of a ladies` salon. I want to ask for advice on this below matter. Recently, we have hired an employee in Nov 2019. She has not completed the probation period; her contract is an unlimited contract. The employee does not have any discipline, how to talk with her? On 02/04/2020, without a notice period, I received a resignation in addition to asking to cancel the visa. So, in this case, how can you help me? For early resignation, are there any rules to get compensation from the employee (45 days)? Please advise, your advice will be highly appreciated! Thanks!

إثبات براءة معلمة اتهمتها المدرسة بخيانة الأمانة وفتشتها

س: السلام عليكم، لدي استفسار. وجّهت مدرسة تهمة خيانة الأمانة لإحدى المعلمات وهي بريئة من التهمة وتم فتح بلاغ في دبي من قبل المدرسة. واليوم قامت المدرسة بإيقاف عملها وقطع الراتب حتى انتهاء القضية، فهل للمدرسة الحق بتفنيشها؟ وكيف لها أن تثبت براءتها؟

إنهاء خدمة العامل أثناء إجازته السنوية بسبب سوء الأحوال الاقتصادية

س: السلام عليكم، تم فصلي بعد ٦ سنوات من الخدمة لظروف العمل الاقتصادية بعد فيروس كورونا. العقد غير محدد المدة. الفصل لم يسبقه إنذار و تم إبلاغي به أثناء إجازتي السنوية. برجاء الإفادة عن المستحقات، خاصة مكافأة نهاية الخدمة إذا كانت تُحتسَب على أساس شهر عن كل عام خدمة حال الفصل التعسفي. أعمل في أحد الفنادق بدبي.

تعذر إثبات نسب طفل إلى أبيه بسبب تعنُّت طليق زوجته وعدم نفي الأبوة عنه

س: السلام عليكم، لقد تزوجت من امرأة منفصلة ومقيمة في المانيا ولديها طفلين من زوجها السابق وهو كان مقيم في المانيا (حاليًا مقيم بالإمارات)؛ حيث أنهم مسجلين في المانيا بالسجل المدني حتى الآن زوجين. أنجبت منها طفلاً وُلد في ألمانيا وأُدرج اسم طفلي تحت اسم طليقها، ولنفي النسب طلبت منه المحكمة مرارًا بأن يرسل إيميل أو ورقة ينفي فيها نسب الطفل، ولكنه يتجاهل الأمر لكي يضغط على زوجتي كي تتنازل عن طفليها منه. طفلي الآن (9 أشهر) لا يملك أي أوراق ثبوتية بسبب هذا الأمر. ذهبت أيضًا هناك وأجريت فحص إثبات الأبوة ولكن القاضية بالمشفى طلبت توقيع طليق زوجتي على تقرير الفحص قبل أن تسلمه للمحكمة الرئيسية لإصدار الحكم بهذا الأمر. هل هناك أي طريقة قانونية تُجبر هذا الشخص على إرسال إيميل أو ورقة إلى السلطات في ألمانيا ينفي فيها نسبه للطفل كما طلبوا منه أو على الأقل إجباره على التعامل بجدية والرد على إيميلاتهم كي نحل هذا الإمر ونوقف ابتزازه بإعاقة مستقبل طفلي وإعاقة أوراقه الثبوتية؟ أنا مقيم بالإمارات. وشكرًا

تأخير الرواتب والاقتطاع منها دون موافقة الموظف

س: تحية طيبة، أعمل في شركة مقاولات وهي غير منتظمة بدفع الرواتب بتاتًا حيث إننا بالشركة نعاني مما يلي: ١- يدفعون الراتب كل ٤٥ إلى ٥٠ يومًا وأحيانًا تصل المدة بين الراتب والآخر إلى ٦٠ يومًا وأحيانًا يدفعون لنا نصف راتب فقط. ٢- منذ بداية عام ٢٠١٩، تم اقتطاع مبلغ ٣٠٠٠ درهم من الراتب دون موافقتي وإلى تاريخه يتم اقتطاع هذا المبلغ شهريًا من راتبي. ٣- هناك راتبين لشهري يوليو وأكتوبر ٢٠١٨ لم أستلمهما ورواتب ٥ أشهر لعام ٢٠١٩ إضافة إلى رواتبي حتى تاريخ هذا الاستفسار حيث إن مجموع الرواتب المستحقة يصل إلى ١٠ رواتب هذا غير الإجازات السنوية. أرجو الإفادة بما يجب علي فعله. كيف أستطيع تحصيل حقوقي من هذه الشركة؟ هل أستطيع المطالبة بالرواتب المتأخرة منذ عام ٢٠١٨؟ وكيف ذلك؟ مع العلم أن عقد العمل الخاص بي غير محدد المدة ولكن لم يتم تجديده من قبل الشركة منذ شهر مارس ٢٠١٩. ولكم جزيل الشكر!

Resignation during the probation period and labor ban in unlimited contracts

Q: I wish to resign during my probation. I am not the right fit for the company, and my job responsibilities and scope have massively changed since my boss was fired. I have been expected to just step in with no support, no additional resources and no change to my contract, job description or remuneration. My calls to my HR Director go unanswered so I have emailed my resignation today. He has replied saying he cannot accept an email. I will have a meeting with him tomorrow to confirm my resignation. 1. Can they refuse to accept my resignation? 2. Do I need to give notice? I will offer a week`s transition to ensure a professional handover but I have read that the Labor Law states one month despite the fact they could fire me without notice. 3. Could I face a labor ban? I am on an unlimited contract. I hold a degree and will be moving my visa to a Freezone. Many thanks!

استرداد الأموال المدفوعة والمطالبة بالتعويض بسبب تأخير تسليم العقار

س: السلام عليكم ورحمة الله وبركاته، اشتريت عقار (شقة) في دبي في نهاية سنة 2016، وتاريخ الانتهاء المتوقع هو يونيو 2019، ولكن حتى تاريخ هذا اليوم نسبة الإنجاز هي 50% فقط، أريد استرجاع أموالي والمطالبة بالتعويض. السؤال: هل الدعوى مضمونة في هذه الحالة؟ وكم أتعاب المحاماه تقريبًا؟ علمًا بأنني دفعت كل الأقساط في موعدها. دفعت 50% تقريبًا من قيمة العقار وأوقفت الأقساط بعد تأخير التسليم.

تجديد عقد الإيجار لمدة ستة أشهر رغم إصرار المؤجر على تجديده لمدة عام

س: سؤال بخصوص تجديد عقد الإيجار لسنة أخرى. نويت التجديد لسنة أخرى، ولكن كنت أتفاوض على مبلغ الإيجار. وافق المالك على التجديد بعد الاتفاق على المبلغ المطلوب. فى نفس اليوم الذى أرسلت له الشيكات اضطرتنى ظروف العمل أن انتقل لعجمان وأنا أسكن فى دبي، فطلبت أن يكون العقد لمدة 6 أشهر فرفض المالك وقال أن التجديد لمدة سنة ولا يمكن الرجوع. قلت له أريد مناقشة بند الغرامة، وكما هو مذكور في العقد القديم أنها 3 أشهر كاملة فناقشته وقال أيضًا لا يمكن تعديله. إلى الآن لم أوقع على العقد الجديد والمالك يرفض تعديل هذا البند في العقد الجديد، علمًا بأن المالك طلب منى إرسال الشيكات كاملة للسنة وأرسلتها له بالفعل. فهل هناك مخرج من هذة المشكلة؟

صحة توجيه المقاول إنذار قانوني إلى الاستشاري وإقامة دعوى تشهير

س: السلام عليكم ورحمة الله وبركاته، الموضوع يتعلق بفسخ عقد مقاول ومالك لمشروع من المشاريع ونحن الاستشاري الخاص بالمشروع. تفاجئنا بقيام المقاول بعمل إنذار قانوني موجه إلى الاستشاري للمطالبة بمستحقات غير صحيحة. علمًا بأن الإنذار موجه إلى الاستشاري ونحن في العقد المبرم بين المالك والمقاول معينين بصفتنا شاهد على العقد ومكتوب بصريح العبارة (الشاهد). السؤال: هل هذا الإنذار موجه بصورة صحيحة من الناحية القانونية؟ وهل يحق لي رفع دعوى قضائية فيما يخص التشهير أو الإنذار إلى جهة موقفها فقد حفظ حقوق الأطراف؟ مع الشكر والتقدير!
