How to check a possible travel ban for unpaid bank loan before returning to the UAE?

Q: My friend has a personal loan with a bank in Dubai and has lost his job. He has paid his EMI without any break until Jan 2022. However, he has exhausted all his savings. He missed the EMI in Feb and is still looking out for a job in Dubai. Would like to know what options are available. Will the bank initiate any legal proceeding immediately like a case or travel ban... etc? Also, would like to know if he is unable to get a job in Dubai, can he still pay the EMI from his home country after securing a job there and restructuring the loan?

The tenant is unreachable upon tenancy contract expiry. What to do?

Q: Hi Legal teams, I need your advice on my case. I am a landlord and my tenancy contract with the current tenant expired today (28th Feb’22). Since Dec 21, we were discussing the renewal over WhatsApp and the tenant was assuring us to renew the contract. However, from last week, the tenant is neither reachable over phone nor email. He is not even replying to our renewal requests. Now, I have a tenant living in my property without an active contract. What could be our best course of action in this case? Can WhatsApp chat be used in case of any dispute? Can I raise a dispute with RERA for eviction in case the tenant is either still unreachable or does not sign the contract? How long do I need to wait before I can seek a RERA dispute? Thanks in advance!

س: السلام عليكم ورحمة الله وبركاته، أردت أن أستفسر عن أحقية المالك في المطالبة بإيجار شهرين بسبب عدم إخطاري له كتابيًا لإخلاء الشقة. علمًا بأنني ذهبت للمكتب الخاص بالبناية وأعلمتهم شفهيًا بأنني لن أجدد العقد ولكن لا يوجد ما يُثبت وقد انتهى عقدي بتاريخ ٢٧ فبراير وانتقلت إلى شقة أخرى. عند ذهابي لتسليم المفتاح، رفض وقال إن عليّ دفع شهرين لعدم إبلاغهم بالإخلاء.

Claiming the amounts paid for a property for breaching obligations by the developer

Q: Hello I`ve booked a unit X (and paid 10%) in a tower C of a Project of 3 Towers (A, B & C) on the basis of a swap to another unit Y in Tower B when the latter is commercialized. There was a confirmation from the sales manager in Whatsapp for this arrangement. When Tower B has been launched, the sales manager requested me an additional 2% to secure the swap to Unit Y which I`ve paid (communications in Whatsapp). After that, he told me that the swap can`t happen based on a newly revised policy when the new unit should cost at least 1.5 the already booked unit. I`ve explained my case to CRM with no follow-up until now. I`ve not signed any SPA yet and I didn`t get yet the receipt of the last 2% sent to the new unit Y. What can I proceed with in case I want to secure the swap to Unit Y in Tower B? As well I want to cancel the whole thing? Thanks in advance for your advice.

Q: Hi, I`m a 21-year-old daughter of parents residing in the UAE. My father is extremely abusive, both verbally and physically. My parents have been married for 22 years, and it`s been 19 years since we came to the UAE. My father has caused injuries to my mom and severely affected her mental and physical health. How to act against abusive husband and retrieve the passport from him?

Q: Hi, My sister and her husband live in AUD. He was abusive and took all her gold and documents. They have a kid and she is pregnant as well. She called the police who took her to the station and then she moved to another relative`s house. The police said they can`t help as there are no bruises and it`s a family court issue. She has no document of her or her kid. What is the best course of action? She does not want to live with her husband for the time being and wants to travel to her parents.

هل تُحتسب أتعاب المحاماة ومصاريف الدعوى ضمن مبلغ المطالبة الأصلي؟

س: السلام عليكم، رفع دعوى تجارية جزئية في دبي قيمة المطالبة فيها 49.999 درهم + رسوم ومصاريف الدعوى + أتعاب المحاماة. في حالة الحكم بالمبلغ المطلوب بالإضافة إلى رسوم ومصاريف الدعوى وأتعاب المحاماة، هل في هذه الحالة يُنظر فقط إلى مبلغ المطالبة وتُعتبر قيمة الدعوى البالغة 49.999 درهم لا تتجاوز الخمسين ألف درهم وبالتالي يكون الحكم نهائيًا غير قابل للاستئناف؟ أم أن رسوم ومصاريف الدعوى وأتعاب المحاماة تدخل في حساب قيمة الدعوى وتجعلها في هذه الحالة تجاوز الخمسين ألف رهم وبالتالي يصبح الحكم قابلاً للاستئناف؟

Will you get a travel ban for failing to pay credit card debts?

Q: Hi Sir/Madam, My name is L. I had 3 credit cards debts and I was terminated from my job in Dubai in 2020 because of Corona. Since then I went back home but was still making the minimum payments to the banks until July 2021. Until now I am getting calls from those banks saying they will bounce the cheque and file a case against me. Since the new law has been passed, I know the bounced cheque can be directly be used as an execution deed without the need to go through a long civil case. My question is when I am back in Dubai, will I get a travel ban and/or jail term? If yes, then I am assuming it is for not honoring the judgment order, then what is normally the term? Kindly advise

How to get a tenant arrested to recover the due rent after eviction?

Q: Dear sir/madam, Currently, I have 2 enforcement cases against my tenant for failing to pay rent. He has been evicted from the flat. A travel ban was issued. An arrest warrant was issued. Q: I am buying a mortgaged property in Abu Dhabi for which I`m required to make payment to the seller`s loan obligation before the Title Deed Transfer, so that bank can issue a mortgage loan clearance letter and release the original title deed document to the seller. Unlike Dubai, I understand there is no process currently in place to "block the property" with Abu Dhabi Municipality at the time the buyer gives a cheque (in the name of the seller`s bank) for the loan obligation. Therefore, my question is, how to minimize the risk of the buyer`s default, i.e., the seller does not transfer the Title Deed to the buyer after the buyer pays a cheque for all the seller`s loan obligation.
