Q: Hello, I joined a company in March and worked for one month on a visit visa. Later I exited the UAE and came back on April by employment permit. My visa was processed in the month of June and the date of residence visa as stamped is June 18. I want to know, which period will be calculated for my probation confirmation? Will it be April or June or March itself? Moreover, if I am to resign now, will I face an employment ban? I am ready to serve the notice period for 45 days but will I get paid for the same period? If the company is relieving me of my notice period by reducing days, do I have to pay money to the company? Please suggest me a solution as I'm looking for a job change. Thank you

Q: I signed a limited period contract. I entered the UAE on 22-09-2017, and my visa was stamped on 10-10-2017. How will the HR calculate my probation period? As per the law, when will my probation period end?

Is it from the date you joined based on the contract between you and the employer or from when the visa was issued? I have a case with a firm and they are claiming in their defence that my date of joining is when my visa was issued. To make it easier, I joined work on 24th June 2018 - Last day 7th July 2019. The company is referring based on the labour contract (Limited), and it says that the contract is from the date I entered the country which is 26th July 2018, although I was here and I started work on 24th June 2018. ( I was terminated and the company is not claiming that). Thanking you!

Q: Good day Ahmed, Offer letter Contract signed between me and the company (Joining date of work): 24/6/2018. MOL Contract was signed: 17/7/2018 (Which says I entered country 26/7/2018 valid 2 years limited contract until 25/07/2020. Last day in the company: 7/7/2019. Did I complete a year? Q: Dear Ms. Rajasree, I am working in a private company in Dubai under unlimited contract. I need some clarification related to the calculation of leave salary and the EOSB. My labour contract was initiated on 02/07/2020 but the company called me for the work on 01/09/2020. I was unemployed for two months. Now, the company terminated me on 01/07/2021 with one month notice ending on 31/07/2021 due to a poor business situation. Now my question is, which date do I have to consider for the EOSB and the leave salaries calculation? My company says that all calculations will start from the date of joining. The UAE government introduced the new Unemployment Insurance Law under the Federal Decree-Law No. 13 of 2022 Concerning the Unemployment Insurance Scheme for Unemployed People. The law aims at providing a sort of financial support in case of unemployment for a brief period, probably to help employees who got terminated find another job and avoid failing in other financial obligations.

The provisions of this Law, known as "UAE Labour Law", govern the relationship between employers and employees and other labour matters in the United Arab Emirates. There are special labour related regulations applicable in some of the free zones in the UAE.

This Decree sets the rules and conditions for the termination of fixed-term (limited) or unlimited (not term-bound) employment contract between employer and worker in the United Arab Emirates.

The provisions of this Decree-Law, known as "New UAE Labor Law", govern labour relations in the private sector of the United Arab Emirates. The New Labor Law repeals the previous UAE Labor Law (Federal Law No. (8) of 1980).
