Q: I am divorcing my wife. She will have custody of our 3 children. My monthly salary is AED 20,000. I have a bank loan that I repay every month, and the repayment amount is AED 9,000.
When the UAE courts calculate 'child maintenance' and 'alimony', will they calculate based on the AED 20,000 that I earn or on the AED 11,000 that is remaining after I pay my monthly loan instalment?
Please advise.

Irretrievable breakdown of marriage and maintenance

Q: Married in India - 3 years - living in Dubai, now it's not working out. She has major insecurity issues.
My relationship with my sister is also promoted as an affair, in the entire society, friends, family and my workplace.
I am not allowed to have female friends. Old friends have been pushed away by saying they should not hang out with me.
I haven't spoken to my old female friends or my sister for 2 years so that she can be ok, however, nothing changed.
Now, after 6 months of living in hostility, we then decided to move out. 3 months of living separately. I am still paying for all her expenses including rent, mobile...etc.
Asked for separation but she says I'm married to her so I should keep paying for her, and she will never let that go.
What are my options?

Divorce by mutual consent and the applicable law

Q: Hello,
I am an Indian Hindu expat residing in the UAE since 2009-12 & 2013 till date and married since 2009. I hold an employment visa and not dependent on my husband.
I have been living separately from him since March 2018 to date and we both mutually want to divorce due to compatibility issues. We do not have children, assets or bank accounts or any liability as a couple.
Please advise if we are to acquire a divorce in the UAE, will it be legit in our home country India?
Are we to request for Indian Hindu laws/procedures for the divorce here?

The legal way of disputing an order from the court of appeal

Q: Hi Dr Amira,
I am a Hindu Indian expat living in the UAE. My husband and I have legal cases going on in India and we are living separately in the UAE.
My husband filed disobedience case against me here and I won the case in the Court of First Instance, but he filed an appeal and he won it in the Appeal Court.
The judgement says I did not provide enough evidence, while I have provided all attested court documents from India.
How can I get the court to re-look at the documents?
Until when do I have time to file the appeal?
I used legal support from a law firm but they have not helped much.
Can you let me know how I can get the court to re-look at the documents, please?

Can the wife file for maintenance in the UAE after judgement in home country?

Q: My wife and I are non-Muslims. Divorce was settled in our home country court which decided that I am the custodian of the children and no alimony has to be paid to her.
Children are living with me here in the UAE. However, she still resides here in the UAE using a tourist visa. She is planning to file a Maintenance Case against me in the UAE Family Court.
Can she do that?
Am I obliged to pay her alimony?

What are the divorce procedures and rights of the wife in Dubai?

Q: My sister and her husband are Egyptian Muslims and live in Dubai. There is a problem between them and could end in divorce.
He doesn’t want to divorce her in Dubai, what are her legal rights to file for a divorce in Dubai?
If he refuses to divorce her, can she go and file a case?
If yes, does she have to go back to the house where the husband is?
And finally, what is the process of divorce when it comes from the wife's side?

I need your help to solve my issue. We have started one tourism company in Sharjah Media City free zone in Jan 2018. I was a 20% shareholder.
But in the month of Nov, my other partner came and asked me to remove my name as a manager from the license because he has some money in KSA and will bring to Dubai and then through this company will transfer to Japan.
He will remove my name from the bank and then he can do this. I agreed verbally. But now I came to know that he transferred my shares to his name. But still, I am receiving the du bills under my name.
The guarantee cheques issued under my signature. We are operating a cruise in Deira. The contract is under my name. for the last 1 year, I have not received any money for my shares.
Immigration card still has my name. 2 days ago, one guy from that partner filed a complaint in Naif Police that I am not the partner and they want me not to come to the cruise.
The cruise agreement is under my name and company name with my signature. Kindly help me in this regard.
