Questions & Answers
How can I take legal action if my husband is cheating on me in the UAE?
Hello,
We’re married under the Hindu Marriage Act in India. My husband has been cheating on me for, as far as I know, four years. After repeated reconciliation attempts from my end and therapy sessions for us both, he just fooled me into believing he was trying.
After a physical fight between us around two weeks ago, he decided not to come back, and despite repeated attempts from my side to request a meeting to talk, he has refused.
His parents know about this and are supporting him. While he is away, he continues to bring women back to his room while we’re still legally married.
What are my rights here in the UAE? Can this be reported? If yes, how?
Hello,
In the UAE, there are specific laws that address domestic issues, including infidelity and abusive behavior.
Since you are legally married under the Hindu Marriage Act in India, it is possible to seek legal recourse in the UAE under certain conditions, depending on the situation.
1. Adultery:
Although UAE law is governed by Islamic principles (Sharia), it does not condone adultery, and it is considered illegal under certain circumstances, especially in the case of a married woman.
2. Emotional and Physical Abuse:
If there was any form of physical abuse during the fight or emotional distress, you have legal rights to protection under UAE law.
Domestic violence is taken seriously, and there are legal processes in place to protect the victims. If there was any physical violence (even if minor), you should consider reporting the physical fight to the police.
Domestic violence laws in the UAE are clear, and if you were harmed, you can seek protection. The police can issue a protection order.
If you want to file for divorce in the UAE under Islamic law, you’ll need to show that there are irreconcilable differences or that his actions, including his cheating, have harmed the marriage.
