Questions & Answers
Is it possible to cancel the visa application if I have not signed the labor contract?
Dear Sir,
I am on a visit visa, searching for a job. I signed an offer letter, but fortunately, I received another offer from a different company, which is better than the previous one.
Now, the first company has applied for my labor contract and visa without me signing any documents. However, I do not want to join that company.
Please advise what I should do.
Hello,
Thank you for sharing the details of your situation!
Since you have not signed any documents with the second company, under UAE Labor Law, you are not legally bound to join them.
I recommend that you promptly notify the company in writing of your decision not to proceed and request cancellation of any visa or labor contract applications made on your behalf.
It is also important to verify your current visa status with the immigration authorities to avoid any complications.
If needed, I can assist you further with drafting formal communications or advising on the next steps to protect your interests.
Please let me know if you would like to schedule a detailed consultation.
Best regards,
You should contact the company that made you the less favorable offer to explain your situation honestly and professionally.
You can tell them that you received another offer that you preferred based on your career goals and that you no longer intend to join them.
You do not need to sign any documents or proceed with the visa process. It is important to be honest and direct in your communication, emphasizing your appreciation for their time and efforts.
Thank you for reaching out!
I understand that you initially accepted an offer while on a visit visa, but have now received a better opportunity and are concerned because the first company has already processed your visa and labor contract without your signature or final consent.
In such cases, if you have not signed the employment contract or taken any action to activate the work permit (such as undergoing a medical test or starting employment), then you are still in a position to refuse to join.
However, since the company has applied for your visa, it is important to cancel that application formally before the new company can sponsor you.
I can assist you in handling this issue properly, including communicating with the company to cancel the visa and avoiding any ban or complications in the system.
