Dear Inquirer,

Thank you for reaching out.

If you have not sublet the property, the landlord cannot rely on Article 20(3) of Law No. 20 of 2006 as a valid reason to evict you. However, each case depends on the specific lease terms, evidence, and communications between the parties.

To protect your tenancy rights and respond properly to the eviction notice, we recommend booking a legal consultation or officially appointing our firm to act on your behalf.

Dear Questioner,

Thank you for your message.

With reference to your situation, and the landlord citing Article 20, Paragraph 3 of Law No. (20) of 2006 (Abu Dhabi Rental Law), this clause generally allows the lessor to request eviction if the tenant sublets the property without written consent from the landlord.

However, since you have not sublet the property, this clause would not apply in your case.

Here’s what you can do:

Respond in Writing: You may formally respond to the landlord, denying any subletting and requesting clarification or evidence supporting their claim.

Request Proof: The burden of proof lies with the landlord. They must demonstrate that unauthorized subletting occurred if they wish to rely on that clause.

File a Complaint (if necessary): If the landlord insists on eviction without legal grounds, you can file a complaint with the Abu Dhabi Rental Dispute Settlement Committee, which will review the case and protect your tenancy rights.

Please let us know if you would like assistance drafting a response to the landlord or filing a complaint with the rental committee.

Best regards,

Hello,

Thank you for your inquiry. Based on your explanation, if you have not sublet the property, then the landlord’s attempt to evict you under Article 20(3) of Abu Dhabi Law No. 20 of 2006 is not legally justified, as this clause only applies when a tenant sublets the premises without the landlord’s written consent.

I recommend formally denying the allegation in writing and requesting the landlord to provide evidence of any claimed subletting.

If they proceed with eviction, you may file a complaint with the Abu Dhabi Rental Dispute Settlement Committee to contest the action.

If needed, I can assist you further with the response letter or legal representation.

Best regards,

Hi.

Thanks for the response.

I have already emailed them denying these allegations and have also asked them to share with me the evidence for the same.

However, till now I haven't received any reply from them.

Can you tell me how the complaint is filed, and do I need to get a lawyer for the same, and what will be the charges?

If you have not sublet the property, the landlord has no valid ground to ask you to vacate based on that reason.

You can refuse to leave unless clear evidence is provided. It’s important to document all communication and avoid signing anything without legal review.
