Procedure to access the bank accounts of the deceased

Dear Madam,

I’m working for a company in Abu Dhabi. My friend/colleague (Non-Muslim) expired in December 2018 (without a will).

He lived in Abu Dhabi for more than 20 years and had an account with money and National Bonds.

What is the procedure to withdraw the money & National Bonds of the deceased from the account?

His wife is in India and not able to visit the UAE. Kindly help me to know the procedures.

Dear Questioner,

I am sorry for your loss. May the soul rest in peace.

I assume that the deceased has not registered a WILL in any of the registries in the UAE. In the absence of a WILL, the family will have to open an inheritance case in the Personal Status Court in Dubai.

Upon the submission of a valid PoA [from all the immediate family members], passport copies of the deceased and of the family [along with the visa page of the deceased] and death certificate [which has to be attested and legalised], the Court will issue Legal Heir Certificate.

I recommend you to hire a lawyer at this stage. During the hearing stage, you will also have to present two male witnesses to promise before the Court with regard to the relationship of the deceased with the applicants of Legal Heir Certificate.
