How can I avoid liability for a car my boss transferred to me without full payment?

Hello,

My boss transferred a car to my name. Unknown to me, the car was not fully paid before the transfer. Eight months later, the seller called me because my boss was unreachable.

The seller threatened to take me to court because my boss didn’t pay the full amount.

How do I get out of this?

Hello,

Thank you for reaching out with your concern!

In the UAE, when a car is transferred to your name, you generally assume responsibility for it, including any outstanding payments, unless otherwise specified in the agreement.

Since you were unaware that the car was not fully paid for at the time of the transfer, I recommend reviewing the sale agreement and gathering all relevant documentation related to the transfer.

You should reach out to the seller to explain your situation and clarify that your boss is ultimately responsible for the remaining payment.

If the seller threatens legal action, it would be prudent to consult with a lawyer who specializes in this area to understand your legal options, which could include pursuing compensation from your boss or taking other steps to protect yourself.

Additionally, if there was any fraudulent activity involved in the transfer, filing a police report may be an option.

If needed, mediation or legal proceedings could help resolve the matter. I can assist you further with legal consultation if you'd like to discuss your case in more detail.

I signed the transfer letter from the seller to my name at the RTA.

It is advisable to reach a settlement with the seller, as you are officially registered as the owner of the vehicle and have signed confirming this.

You must go back to your manager to solve this problem because you are jointly responsible with the manager, and the burden of proof falls on you.

Therefore, the best solution is to go back to your manager to solve the problem through negotiation. If you do not reach a peaceful solution, you can file a lawsuit against your manager for fraud.

You were not a party to the original car sale agreement between your boss and the seller. You had no knowledge of the unpaid amount.

The car was transferred to your name by your boss. This transfer implies that the car was clear of any financial encumbrances.

Collect all the evidence and respond to the seller. If he is not willing to cooperate, it will be better to negotiate with him through a lawyer.

We will handle the procedures. Kindly share your WhatsApp number to discuss further.

Dear Inquirer,

If a car was transferred to your name without full payment being made to the original seller, you may be held legally responsible as the registered owner, even if you were unaware of the financial obligation. This situation could lead to legal claims or court proceedings against you.

To protect yourself, it is essential to review the sale agreement and registration documents and take immediate legal action if needed.

We recommend booking a consultation with us to assess your legal position and take appropriate steps to avoid liability. You may also consider officially appointing us to represent you in this matter.

Best regards,

Dear Questioner,

You can prove the invalidity of the car sales contract due to the lack of a relationship with the seller by filing a lawsuit against the company and the seller.
