Claiming salary and end of service benefits without a visa

Hi Anitha,

You were recently answering my questions under 'Claiming the salary and entitlements for termination during probation' and you suggested that SHAMS would take up the issue of the employer not issuing a work visa/permit as well as not paying the owed salary.

I had been emailing SHAMS for the past week or so and they put me in touch with an adviser from virtualzone.ae.

After explaining the situation to them, they said that as I didn't have a visa then it's classed as a personal dispute and not under SHAMS Free Zone scope and that they won't help me.

Could you please advise on what my next step should be? Do I need to take out separate legal action?

Dear Mr Mark S.,

Thanks for coming back.

As SHAMS gave a reply on those wordings, I think it is better to proceed legal action personally for which you can approach the labour court directly or you can appoint a lawyer for this.

Please let me know for any other concerns.

Is there somewhere that I can find information about how to go about using the labour courts?

If I were to appoint a lawyer, how much is that likely to cost?

Is this the sort of work that you would partake in?
