Claiming the salary and entitlements for termination during probation

I moved to Dubai in August 2018 and I am sponsored by my wife. I started working for a company in October 2018 until they terminated me in January 2019.

The company is a joint venture between a DWC company and a Sharjah free zone company. I have an employment contract which states it abides by the UAE labour law and free zone labour law.

The company advised me that I did not require a work permit/visa. Since my employment was terminated on 17th January 2019, I have not received my final salary as well as other monies owed.

MoHRE and JAFZA have not been able to help. What action can I take to get my money?

Dear questioner,

Thank you for contacting online.

First, you have to complain to the labour disputes authority concerning your visa, and if the matter is not settled there, they will refer the matter to the labour court.

Since your visa is with Sharjah free zone, JAFZA will not entertain your matter.

When you make a complaint to the authority concerned, the employer also will be called for and if not settled, then it will be transferred to Labour Court wherein you can appear personally or through a lawyer.

Please explain why I need to complain to the labour disputes authority concerning my visa as I didn't have one.

What is the best way to contact the labour disputes authority?

Whom do I contact at the Sharjah free zone to make the complaint?

Even though you were under the sponsorship of your wife, there will be a work permit obtained by the company in your name which enables you to work.

You can directly approach the Sharjah free zone authority and check for the complaint section.

I do not believe they obtained a work permit for me.

If this is the case, will it affect my ability to recover my owed monies?

For working with a company either a labour card or work permit is a must. So if they have not made any work permit for you , by what mode they transferred your salary? Based on that you can complain.

They paid me by direct transfer into my and my wife’s bank account.

Complain to the authority and if needed produce the documents to show the salary transfer and also mention about their failure to take out work permit for you.
