Can I resign during the probation period without serving a three-month notice to take another job?

I am working in the private sector, and currently I am in the probation period. I got a government job, so I submitted a one-month resignation notice.

My current company rejected my one-month notice and ordered me to serve a three-month notice (as per the contract).

I enquired with One Time Centre, and as per their advice, after one month, I can stop work and register a complaint against my company.

For this matter, how will the UAE law help me to solve it?

As per UAE Labour Law (Federal Decree-Law No. 33 of 2021, Article 9), an employee is legally allowed to resign during the probation period without serving notice when moving to a government job.

Your employer cannot legally enforce a three-month notice period in this case.

As per the contract, you have to serve 3 months upon resigning. By law, you are obligated to serve the 3-month notice.

If you don't want to, you can pay the company and leave, or you can discuss and get into an agreement with the company on how you can do this in a way that serves everyone's purpose.

As per the law, the notice during the probation period is 14 days. But as per your query, you have signed a contract in which a three-month notice is required.

In law, an established principle applies in such cases (PACTA SUNT SERVANDA). In short, the law of the parties and agreements must be kept.
