Q: I've purchased an off-plan property in Dubai which was due for handover in Dec 2017 but still incomplete (approx. 80%). 70% has been paid from a purchase price of 1.8 million. Am I entitled to compensation for the delay or can I cancel the purchase in its entirety? Thanks

Q: I bought a property in Abu Dhabi and the completion date as written in the agreement is in 2014 and the project has not been finished to date. I have contacted the developers several times and met with them and they keep failing their promises. What do you advise, should I file a case to terminate the Sale & Purchase Agreement (SPA), can I claim for compensation for the delay?

Q: In June 2008, I bought an office in DSO, for AED 847.339. The completion date was December 2010. For 8 years, the developer dragged the construction for unknown reasons. I, therefore, did try through RERA and the Notary Public, to get my money back for breach of contract but the developer refused to answer my request. Today, 8 years later, the office is ready for the final handover. In between, I lost 8 years of rent (AED 360.000) and the opportunity to sell that office when the market was still high. Last but not the least, the developer just informed me verbally that the office that was freehold is now leasehold despite what is stipulated in the signed SPA. Today, I would like to know what are my legal options to get my money back or at least get some compensation.

س: السلام عليكم ورحمة الله وبركاته، بداية أشكر لكم جهودكم! أنا سيدة تعاقدت مع مكتب استشاري على تشييد منزل سكني بإمارة دبي وللأسف لم ينهِ المقاول المشروع حسب المدة المحددة بالعقد وتوجد عيوب في تنفيذ أعمال الطابوق والخرسانات حسب التقرير الفني من بلدية دبي. كما أن المخططات المعتمدة من قبلي لا تتوافق مع الواقع في المشروع. وبمراجعة مكتب الاستشاري، لم يعترف بما ذكرته وإنما يلقي اللوم عليّ للهروب من المسؤولية ودفاعًا عن المقاول مع العلم أن نسبة إنجاز المشروع ٣٥ بالمائة فقط وقد سددت مبلغ يعادل ٥٠ بالمائة من قيمة العقد. أرجو منكم توجيهي في مثل هذه الحالات. جزاكم الله خيرًا!

س: السلام عليكم، أنا مواطن سعودي. اشتريت شقة في دبي من شركة وكان الاتفاق حسب العقد المبرم بيننا أن ينتهي التشييد في الربع الأول من عام 2020، ولكن للأسف الشديد لم ينجز سوى 20٪ من المشروع وأريد استرداد أموال من المطور علمًا بأنني دفعت كامل المبلغ خلال الربع الأول من عام 2019.

س: اشتريت شقة فندقية على الخارطة لتتم إدارتها عبر المطور لاحقًا عند الانتهاء. المفروض إنجاز المشروع بنهاية ٢٠١٩، ولكن لغاية الآن لم يتم الإنجاز (آخر نسبة إنجاز رسمية حوالي ٦٥٪ نهاية ٢٠٢٠). هل يمكن فسخ العقد واسترداد المبلغ المدفوع من طرفي والذي يمثل ٢٠٪ من قيمة العقار؟

س: السلام عليكم، هل من حقي طلب التعويض عن فترة التأخير في التسليم؟ لا أرغب في إنهاء الاتفاقية واسترداد الأموال المدفوعة. هل يمكن استلام الوحدة وطلب التعويض فقط بسبب التأخير في التسليم الذي وصل إلي ٥ سنوات الآن؟

This Law establishes interim property register in which sale contracts, off-plan sales, and other off-plan legal dispositions of real property are registered prior to inclusion in the property register maintained by Dubai Land Department.

The provisions of this Law supersede articles (2) and (11) of Law No. (13) of 2008 Regulating the Interim Property Register in the Emirate of Dubai.

This Resolution approves the Implementing Bylaw of Law No. (13) of 2008 Regulating the Interim Property Register in the Emirate of Dubai.
