Ras al Khaimah, UAE

Can we legally act against community management for a noisy pool unit?

Hello,

We live in a development in Ras Al Khaimah, and under our apartment block, there is a loud swimming pool heater/chiller unit that runs 24/7, producing a rattling and humming noise that disturbs our peace.

We can hardly use our balcony due to this noise. Other apartments face the same issue, but the community management refuses to take action.

What legal recourse do we have? Can we serve the community management office with a legal notice?

Dear Salah,

Thank you for your inquiry regarding the noise disturbance caused by the swimming pool heater/chiller unit in your Ras Al Khaimah development.

Under UAE law, residents are entitled to peaceful enjoyment of their property, and disturbances like excessive noise may constitute a violation of this right.

The community management is obligated to address any issues that impact residents' quality of life, including noise from shared facilities.

Steps to Take:

- Formal Complaint:

Submit a written complaint to the community management detailing the noise issue and its impact on your living conditions.

- Legal Notice:

If management fails to act, a formal legal notice can be served, demanding action within a set timeframe.

- Further Legal Action:

If unresolved, you can escalate the matter to the relevant regulatory authorities or initiate legal action through the courts.

It is also important to gather evidence, such as audio recordings and witness statements from other affected residents, to support your case.

Please let me know if you'd like to proceed with any of these steps or need further assistance.

Best regards,

Mohammed Salah

Hello,

Submit a written complaint to the building’s management and request an official response. If multiple residents are affected, a joint complaint will strengthen the case.

If management does not act, file a complaint with RAK Municipality or RAK Real Estate Regulatory Authority (RERA).

Authorities may inspect and order noise reduction measures. If complaints are ignored, a formal legal notice can be sent to the management office demanding action within a specified time.

The resident can file a civil claim for damages if the noise significantly affects their quality of life.

Dear Sir/Madam,

Thank you for bringing this matter to our attention regarding the noise disturbance from the swimming pool heater/chiller unit in your Ras Al Khaimah development.

I understand the impact this is having on your quality of life and appreciate your concern. Based on the information provided, I would like to offer the following professional advice:

1. Documentation:

Begin by thoroughly documenting the noise issue. This should include:

- Dates and times of disturbances,

- Decibel readings (if possible),

- Video or audio recordings of the noise, and

- Written statements from other affected residents.

2. Formal Complaint:

Submit a formal, written complaint to your community management office. Detail the issue, its impact, and request specific actions to address the problem. Keep a copy of this correspondence for your records.

3. Municipal Intervention:

File a complaint with the Ras Al Khaimah Municipality. You can do this through their official website (rak.ae) or by visiting their customer service center in person.

4. Environmental Agency:

Consider contacting the Ras Al Khaimah Environment Protection and Development Authority (EPDA). They may be able to assess whether the noise levels violate any environmental regulations.

5. Legal Notice:

If the above steps do not yield results, you may consider serving a legal notice to the community management office. This should be drafted by a legal professional to ensure it meets all necessary requirements.

6. Dispute Resolution:

As a last resort, you may file a case with the Ras Al Khaimah Real Estate and Rental Dispute Settlement Committee. They have the authority to adjudicate such matters.

7. Collective Action:

Given that other residents are affected, consider organizing a collective approach. This could involve a joint petition or legal action, which may carry more weight with the authorities.

Remember to maintain professional communication throughout this process and keep detailed records of all interactions and correspondence related to this issue.

Please don't hesitate to ask if you require further clarification or assistance.

Yours sincerely,

ABDUL WAHIED
