Questions & Answers
What can I do if the judge refused to allow bail in an appeal of fraud case?
In the hearing recently, the judge said "The appellants appeared in person - remote trial and did not surrender themselves for execution for their presence in the courtroom" on the next hearing date.
He did not give Kafala (bail) while I appeared online. The court is the Appeal Court of Ajman. The last judgment is 2 years jail sentence and deportation with a big fine for a fraud case.
What will happen now in the next hearing?
Greetings.
Have you filed an appeal?
The other party can respond to the appeal and then you can comment and then the decision will be issued either to cancel the ruling or to uphold it according to the evidence presented.

In your case, since the last judgment was two years of jail, deportation, and a significant fine for fraud, the next hearing will likely involve the enforcement of this judgment unless an appeal or reconsideration has been filed.
If an appeal is pending, the court may review the case and based on legal arguments, a sentence reduction or modification may be possible.
Given the seriousness of the matter, we strongly recommend seeking professional legal assistance to explore potential legal remedies, such as filing an appeal, requesting a sentence reduction, or negotiating a settlement if applicable.
We can provide you with legal support to navigate this situation effectively.

Consult your lawyer immediately to assess your chances in the appeal. Prepare a strong defense if you are challenging the ruling.
Discuss the possibility of settlement if the case involves financial disputes. Be aware that avoiding surrender may negatively impact the appeal outcome.
If you need further legal guidance, it's best to have a UAE-licensed lawyer represent you in court.

Based on the judge's statement, the appellants appeared remotely but didn't surrender themselves to attend the courtroom.
For the next hearing in the Ajman Appeal Court, given the previous judgment of 2 years jail, deportation, and a large fine for fraud:
1. The court may insist on physical presence.
2. Failure to appear could result in arrest warrants or proceeding in absence.
3. Not surrendering might negatively impact the appeal.
4. If present, appellants can present appeal grounds and new evidence.
5. The court will review the case and may uphold, modify, or overturn the original judgment.
Given the serious sentence, it's crucial to comply with court orders and consider legal representation.
