I was terminated. What happens if I leave before the end of notice period?

Greetings!

I just want to ask for clarification.

My company renewed my visa three months ago, but now I am being terminated because I am an existing staff member.

This is because our department will no longer remain beyond the end of December 2024 due to a management change.

The company informed me of my termination only four days ago, but I have a three-month notice period.

Is it correct that if I leave before completing the three-month notice, I will have to pay a penalty?

Or, since they are terminating me, am I entitled to complete the three-month notice period without any penalties?

I just want to understand my rights regarding this situation.

Hello,

Under UAE Labour Law (Federal Decree-Law No. 33 of 2021 on the Regulation of Labour Relations), the notice period must be followed unless both parties agree otherwise.

If your employer terminates your contract, they are required to let you work through the notice period or compensate you for the remaining period if they decide to release you earlier.

However, if you choose to leave before completing the notice period, you may be required to compensate your employer for the remaining days, unless they agree to waive it.

Your rights in this case include receiving full salary and benefits throughout the notice period and any end-of-service gratuity if you have completed at least one year of service.

You are also entitled to any unused leave balance and a repatriation ticket if your contract includes it.

If the company does not pay you your dues after termination of service, you can file a complaint with the Ministry of Human Resources and Emiratisation (MOHRE).
