Q: Hi, I have put 5% deposit on a property in Dubai and I have also paid 2% DLD fees + OQOOD. I have more payments starting in 2 weeks but I can't afford to continue with the purchase. Am I entitled to any money back?

Q: I invested in a Dubai property in 2007. It was completed in 2016. In my handover notice was included a size increase letter which says my property size has increased by 50% and I now need to pay an extra 463,000 AED. Under Executive Council Resolution No. (6) of 2010 Approving the Implementing Bylaw of Law No. (13) of 2008 Regulating the Interim Property Register: "Any area in excess of the net area of the sold Real Property Unit may not be taken into consideration. Unless otherwise agreed, the developer may not claim the value of such extra area." The developer is saying because I agreed to pay for any increase in my SPA which I signed in 2007 I have to pay for the increase. I am saying since the law came out in 2008 and decree 6 came in 2010 they would have to agree the increase with me again. Can you please advise.

Q: When buying an off-plan property from a developer, does the SPA have to be reviewed, agreed and signed by both the buyer and the developer representative before paying the DLD + Oqood? Is there a local estate law or clause requesting DLD + Oqood should be paid before the SPA is released from the developer to the buyer? I am seeking this advice because the developer is asking for DLD + Oqood to be paid before the SPA is released despite having paid the initial deposit of 5% as per the Sales Offer schedule. Q: I purchased an off-plan property a couple of years ago from a Dubai based developer. After multiple delays, the developer has agreed to allow me to withdraw from the SPA and swap with another unit they are offering in another building that has been handed over. As part of the cancellation, am I allowed to claim back the 4% fee I paid on the original property from DLD?

Q: Dear Lawyers, I bought an off-plan unit in Dubai and paid 10% advance and 4% DLD. The developer has placed a 10% advance in the escrow account and 4% DLD under his own account to pay for DLD. All money has been debited from my account and SPA signed. I'd like to discontinue the project and terminate the SPA. The developer has a 10% retention clause for any amount deposited with them which I understand but my question is can I get the DLD fee back? I haven't received any title deed or Oqood registration. How can I communicate to them officially to stop DLD registration if not done? Whenever I ask they say it's under process, I also never received any DLD reference number or email confirmation. Would appreciate your clarification. Thanks

This Law establishes interim property register in which sale contracts, off-plan sales, and other off-plan legal dispositions of real property are registered prior to inclusion in the property register maintained by Dubai Land Department.

The provisions of this Law supersede articles (2) and (11) of Law No. (13) of 2008 Regulating the Interim Property Register in the Emirate of Dubai.

This Resolution approves the Implementing Bylaw of Law No. (13) of 2008 Regulating the Interim Property Register in the Emirate of Dubai.

This Resolution sets the fees for registration of real property dispositions in the real property register, including those related to completed, under-construction, or offplan real property, as well as the fees for services provided by Dubai Land Department.
