I bought a holiday package from a tourism company and they breached the contract terms. What to do?

I bought a holiday package from a tourism company. The main privilege is to get a 6N/7D annual holiday for 2 adults and 2 children on a bed and breakfast basis with return airport transfers and 1 sightseeing tour in 4-star associated worldwide hotels for a period of 5 years.

Fast forward to my 2nd-holiday request for Jan 6-9, 2025 in Victoria, British Columbia, Canada, the hotels they've been providing me are all non-inclusive of breakfast and mostly are 3-star rated except Double Tree by Hilton hotel.

I insisted that I would not accept any of the hotel options since they were not following the contract by not providing breakfast as well.

What they did is they provided me options with breakfast but all are located in Toronto, Ontario, Canada. My flight ticket and itinerary are arranged, and although they don't say it, what they imply in their last proposal is for me to change the state I should visit in Canada.

I want to know if they are allowed to do this or if I can sue them.

According to UAE law, if the tourism company fails to fulfill the terms of the contract, including providing 4-star hotels and breakfast, you are entitled to file a complaint or even sue for compensation.

The contract should specify your rights and the company's obligations, and you can claim compensation for any damages resulting from your failure to comply.

For precise advice on how to proceed with your case and handle the company, feel free to contact us via WhatsApp. Our office specializes in contract disputes and commercial matters, with extensive experience in providing tailored legal solutions.

Dear Client,

Thanks for your question!

I hope you are doing well. I will assist you in this matter.

A tourism company breaches contracts by offering 3-star hotels without breakfast in different locations. You have the right to demand the original contract terms: 4-star hotels with breakfast in Victoria.

Document all communications and contract details as evidence. Insist on fulfillment or seek compensation through customer service and management.

Consider legal consultation if the company remains uncooperative in resolving the contract violation. Thanks & Regards,

The contract explicitly states "6N/7D annual holiday for 2 adults and 2 children on bed and breakfast basis with return airport transfers and 1 sightseeing tour in 4-star associated worldwide hotels."

By offering 3-star hotels without breakfast in Victoria, they may be violating this agreement.

While the contract might not explicitly state a specific destination within a country, forcing you to change your chosen destination (Victoria to Toronto) could be considered a significant alteration to the agreed-upon terms.

Send a formal written complaint to the tourism company, clearly outlining the contract terms, the company's failure to comply, and your requested resolution.

If they are not responding, we can initiate a legal notice through court for breach of contract. If you need further clarification, kindly share your WhatsApp number.

You have a written contract with the tourism company that clearly states the terms of the holiday package, including "6N/7D annual holiday for 2 adults and 2 children on bed and breakfast basis with return airport transfers and 1 sightseeing tour in 4-star associated worldwide hotels for a period of 5 years.

By not providing hotels with breakfast included and offering mostly 3-star hotels, the company is not fulfilling the terms of the contract.

The company cannot unilaterally change the destination from Victoria, British Columbia, to Toronto, Ontario, as this is a significant change to the agreed-upon itinerary.

You may have grounds to sue the tourism company for breach of contract in UAE. If you need further assistance kindly share your Whatsapp number.
