What is the procedure to evict my tenant who failed to pay the rent?

My tenant was supposed to pay me his second installment last month which he didn't. Then I sent him a legal notice through Enjaz to pay within 21 days.

Now after 21 days, he mailed me saying he will pay next month.

What is the procedure to proceed with eviction and get the payment for the time he lived in?

Hello,

To proceed with eviction, you can file a complaint with the RDC. This will involve submitting your contract, legal notices, and proof of non-payment.

If the tenant does not vacate the property voluntarily after receiving the eviction order, you can ask the court for enforcement through the Dubai Police, who will assist in physically removing the tenant from the property.

The RDC will assess the unpaid rent as part of your eviction proceedings. The tenant may be liable for compensation for the time they occupied the property without paying, depending on the ruling of the court.

We have to file the dispute for the immediate eviction with Rental Dispute centers.

Hence you have already served him the legal notice for nonpayment of rent, it will be enough to prove that he breached the contract.

Now Serve the tenant with a formal Notice to Vacate. This notice should be notarized and delivered through registered mail or a certified courier service.

The notice should clearly state the reasons for eviction (non-payment of rent) and the date by which the tenant must vacate the property.
