Could the court have transferred the execution amount to an incorrect account?

Good day,

It's driving me nuts, and I can't sleep. I'm just asking: is there a possibility that the court transferred the execution amount by mistake, or that Al Adheed entered a different IBAN for my case?

Will the court notice that the account is under a different name or something?

I haven't been sleeping, and nobody can give me a proper response.

Hello,

If the amount was transferred to a different IBAN or under a different name, the court is likely to notice during the execution process.

You may want to follow up with the court to ensure there are no errors.

Dear Questioner,

Good day!

Thank you for reaching out with your concern. I understand how stressful this situation can be, and I will do my best to clarify the matter for you under UAE law.

Regarding your question about the possibility of the court transferring the execution amount by mistake or the use of a different IBAN in your case, it is indeed important to ensure that the correct account details are used for any financial transfers ordered by the court.

- IBAN Mismatch or Mistake:

If the court is transferring funds to an IBAN that is not associated with your name or the proper recipient, there is a risk that the transaction could be flagged or delayed.

Courts and financial institutions generally have systems in place to cross-check the details, and discrepancies in account names are likely to be noticed. If the IBAN provided is not registered under your name, it could lead to complications in the execution of the payment.

- Court’s Review:

The court typically ensures that the correct details are used when making a financial transfer. If the wrong IBAN has been provided, the court would usually detect this issue and may not process the payment.

It is possible that they may request clarification or additional documentation to confirm the correct account details.

However, if this mistake occurs, you should immediately contact the court or the relevant authority (e.g., the execution department) to correct the details to prevent delays.

Given the seriousness of this concern, I recommend that you verify the IBAN details with the relevant authorities or directly with the court handling your case to ensure there are no issues or mistakes.

If you have any further doubts or need assistance in addressing this matter, please do not hesitate to reach out, and we will be happy to guide you through the process and help resolve any potential issues promptly.

Please rest assured that the court will generally aim to ensure that the payments are executed properly, and any discrepancies can be rectified if raised.

Wishing you peace of mind as we work through this together.

Best regards,

Mohammed Salah

The court will verify all details, including the account number and beneficiary name, before authorizing any fund transfer.

This process involves multiple checks and balances to ensure accuracy. If the account number or beneficiary name provided by Al Adheed doesn't match the court's records, the transfer will likely be flagged and rejected.

Banks also have systems to verify account details before processing transactions.

Mistakes can happen, but systems are generally in place to catch these errors before they result in significant problems.

If you suspect there has been an issue with how your case’s execution amount was handled, taking proactive steps by communicating with the relevant parties is essential.

Yes, the court does not send the amount if the name of the applicant for execution is fabricated in the bank certificate.

The court's accounts department verifies transactions first before the transfer, but mistakes can happen.
