The visa should be canceled automatically after six months; how is this done?

Hello,

I was laid off from my job in January 2024 and had to leave the UAE without canceling my visa due to a family emergency. It's been months, and my visa and EID are still active.

As far as I know, after six months, they should be canceled automatically. How is this possible?

I asked GDRFA about it, and they told me to discuss it with my employer, but they are not responding. I want to come to Dubai as a tourist now.

Please help me. What should I do?

Dear Client,

Thanks for your question! I hope you are doing well. I will assist you in this matter.

Check with GDRFA to confirm if your visa is still active due to employer non-cancellation. Contact your employer formally to cancel the visa, or consult with us if unresponsive. Once canceled, you can apply for a tourist visa to enter Dubai.

For any further legal assistance, you can WhatsApp us. We have an extensive team of knowledgeable and experienced lawyers to provide the legal assistance you need.

We will be happy to help you.

Thanks & Regards,

ABDUL WAHIED

According to UAE law, if more than 6 months have passed without canceling your work visa, fines may apply for the delay in cancellation.

You should contact your employer or HR department to cancel your visa. If you want to return as a tourist, you may apply for a new tourist visa, but resolving your visa issue may be necessary first.

Dear questioner,

First of all, we can check whether there are any travel restrictions imposed on your name as well as the status of your visa. Once confirmed, if the visa is still active, you can come to the UAE and cancel the visa.

If the visa is not active, you can come with a visit visa.

If you need our assistance in this matter, kindly share your WhatsApp number.

Thank you for reaching out regarding your situation. I understand the challenges you're facing and am here to assist you.

Typically, if a UAE resident remains outside the country for more than six months, their residence visa is automatically nullified.

However, there are exceptions, and the automatic cancellation may not always occur. Since your visa and Emirates ID are still active, it's possible that your visa remains valid.

Attempting to enter the UAE on a tourist visa while your residence visa is still active can lead to complications, as the immigration system may flag the active residence visa. Therefore, it's essential to address the current status of your residence visa before making travel plans.

Given that your former employer is unresponsive and the General Directorate of Residency and Foreigners Affairs (GDRFA) has directed you to them, I recommend the following steps:

- Official Visa Status Check: Verify the current status of your residence visa through official channels, such as the Federal Authority for Identity, Citizenship, Customs and Port Security.

- Initiate Visa Cancellation: If your residence visa is still active, you may need to initiate its cancellation. This process typically requires the sponsor's involvement, but given their unresponsiveness, you might need legal assistance to facilitate this.

- Apply for a Tourist Visa: Once your residence visa is properly canceled, you can apply for a tourist visa to re-enter the UAE. Ensure all previous visa issues are resolved to prevent any entry complications.

Navigating this process can be complex, especially with unresponsive employers. I can assist you in liaising with the relevant authorities and ensuring all procedures are correctly followed to facilitate your return to Dubai.

Please feel free to contact me via WhatsApp or phone at [---------] to discuss your situation in detail and explore the best course of action.

Best regards,

Suhail Rana
