Can a company fire me falsely claiming platform closure and withhold payments unfairly?

Dear Sir/Madam,

I joined a well-known and reputable company in June as an e-commerce sales executive. After three months, they fired me, citing the reason in my termination letter that they are closing their online platform.

This claim is absolutely false, as the platform is still operational in the UAE. It feels completely unjust despite my hard work and proven sales record, once their platform was established, they simply terminated me.

After my termination, they gave me an additional 30 days to find another job, stating they would not cancel my visa during this time, apart from the standard 14-day notice period.

I recently spoke to a friend who was also terminated under similar circumstances. The company refused to pay him for no valid reason and deducted money from his dues as fines or penalties.

Dear Questioner,

Good morning!

Your situation falls under UAE labor law, and it appears your termination may not be fully compliant. Here's a summary of your rights and options:

1. Termination Without a Valid Reason:

Under UAE Labor Law (Federal Decree-Law No. 33 of 2021), termination must be for a legitimate reason. If the company's stated reason (closure of the online platform) is false, you may have grounds to challenge it.

2. Compensation:

If the termination is deemed arbitrary, you may be entitled to compensation, including:

- Outstanding salary.

- End-of-service gratuity.

- Compensation of up to three months' salary for unfair dismissal.

3. Visa Period:

The company offering an additional 30 days to find a new job is reasonable, but they are still required to fulfill all legal obligations upon termination, including payment of dues.

4. Legal Action:

If the company deducts money unfairly or refuses payment, you can file a complaint with the Ministry of Human Resources and Emiratisation (MOHRE).

We can assist you in filing a formal complaint and representing you to secure fair compensation. Contact us to handle this professionally at [--------].

Best reagrds,

Mo. Salah

Hello,

If your company has terminated your employment without a valid reason (i.e., they say they are closing the online platform, but it's still operating), this could be considered unjust dismissal.

Under UAE Labor Law, an employer must provide a legitimate reason for terminating an employee. False reasons for termination are grounds for a claim for compensation or wrongful dismissal.

If your termination was not in line with the contract or legal requirements, you have a case for wrongful dismissal.

You can file a complaint with the Ministry of Human Resources and Emiratisation (MOHRE).

For a detailed discussion, kindly share your WhatsApp number.

I contacted MOHRE, and they said it is the company's right to terminate you within the probation period without providing any reason.

Dear questioner,

If the company is terminating you illegally and you have evidence to support this, and if you were not terminated during the probation period, then you can file a case with MOHRE. However, this is only recommended if sufficient evidence is available.

If the company is deducting amounts or holding them unnecessarily, you have every right to file a complaint against the company.

If you need further clarification, kindly share your WhatsApp number.

Welcome,

Based on what you've mentioned, if your termination was unjust or if your dues were not paid as they should have been, you can take legal action against the company.

It’s important to clarify your legal rights regarding unfair dismissal and unpaid entitlements.

Feel free to book a consultation for further details.

Hi,

I’m sorry to hear about your experience. Terminating your employment in this manner can seem unfair and illegal in some cases.

Here are steps you can take to ensure your rights under UAE labour law:

1. Understand your legal situation:

- During the probation period:

If you are still in the probation period, the company can terminate your contract without giving a clear reason, provided they provide 14 days’ written notice.

- After the probation period:

If you have completed your probation period, the termination must be justified and legal; otherwise, it can be considered an arbitrary termination.

2. Receive your benefits:

Upon termination, you are entitled to all your benefits, including:

  • Your salary for the days you worked.
  • Any additional benefits, such as unused leave or commissions, if applicable.

Kindly contact us for further assistance.

Thank you for reaching out and sharing your concerns about your termination!

Based on the details you’ve provided, it seems there may be a potential case of unfair dismissal and non-compliance with UAE labor laws.

Under UAE law, employers are required to follow specific legal procedures when terminating employees, including proper notice periods, clear justifications for termination, and payment of all dues such as end-of-service benefits.

If their reason for termination is found to be false or unjustified, you may be entitled to claim compensation for wrongful dismissal.

Additionally, deductions from salaries or end-of-service benefits as "fines" or "penalties" are illegal unless explicitly outlined in your employment contract or proven to result from a genuine breach on your part.

I recommend discussing this matter further to explore your legal options and help you claim what you’re entitled to.

You can reach out to me via WhatsApp or phone to schedule a consultation. Together, we can review your employment contract and termination documents and take the necessary steps to ensure your rights are protected.

Looking forward to assisting you!

Best regards,

Suhail Rana
