Terminated due to redundancy. Am I eligible for compensation?

Dear Sir/Madam,

I have been terminated from my company with a 30-day notice period after serving 11 months. According to my manager, my role has become redundant, and they aim to reduce expenses.

However, they did not mention any reason in my termination letter. Moreover, they are requesting me to train my replacement during my notice period.

I would like to understand if I can receive compensation due to unfair termination and whether I am obligated to provide training to my replacement.

Dear Questioner,

According to the new Labor Code, an employee is not entitled to compensation for termination of a contract with him.

In the notice period, the employer has the right to entrust you with the training of any new employee.

You have the right to be absent from work one day a week, (without salary) to look for a new job, after agreement with the employer.

I was informed by someone else that I am not responsible for the training and I can file a complaint.

Could you please reconfirm?

I am on a Jebel Ali Free Zone visa.

What that person is saying is inaccurate, and he is talking based on the old labor law, and it makes no difference if the visa is in Jebel Ali or somewhere else.

Dear Questioner,

Either party can terminate the limited employment agreement so long notice is served and paid for.

During the notice period, employees are obligated to continue their duties, including training the successor.

Unfortunately, I don’t see grounds for claiming arbitrary dismissal based on shared facts, nor for compensation.

Thank you for your advice!

Are they not supposed to specify the reason for termination in the letter?

I don’t see it makes a difference, in the context of this situation.

Dear Client,

Thanks for your question! I hope you are doing well. I will assist you in this matter.

You might be entitled to compensation for unfair termination in the UAE if your dismissal lacks a valid cause.

Training your replacement is not mandatory, but you can negotiate it as part of your exit terms. Consult with us or the Ministry of Human Resources and Emiratisation (MOHRE) for guidance.

For any further legal assistance, you can WhatsApp us. We have an extensive team of knowledgeable and experienced lawyers to provide the legal assistance you need.

Dear Questioner,

During probation, you are not required to provide any of the recruitment expenses including training costs to the company.

You are free to leave during the probation period. And regarding compensation due to unfair termination, the reason of redundancy does not fall under the category mentioned in the amended UAE Labor law.

If you need further clarification, we will arrange a legal consultation session for a charge.

Dear client,

Yes, an employee can be terminated in the UAE under certain circumstances such as redundancy, poor performance, misconduct, expiry of contract, etc, by serving a notice period.
