Questions & Answers
How can I get my visa canceled for new employment if my free zone company has gone bust?
Dear Lawyers,
I am a free zone employee who resigned from the company. The company went bust and cannot cancel my visa. I raised a dispute with the Free Zone Authority, which was then transferred to MOHRE, and now I have to approach Al Adheed.
I need to cancel my visa so that I can get hired elsewhere. The Free Zone Authority advised me to submit a court letter.
Is this the NOC they are requesting? My priority is not receiving my dues but rather getting my visa canceled.
Dear Questioner,
Thanks for your inquiry!
According to UAE labor law, it is the responsibility of the employer to cancel the employee's visa upon termination of employment.
However, if the employer is unable to do so, the employee can approach the relevant authorities for assistance.
In your case, since the company has gone bust and is unable to cancel your visa, you have already taken the necessary steps by raising a dispute with the Free Zone Authority and transferring it to MOHRE.
The next step would be to approach Al Adheed, as advised by MOHRE.
In order to cancel your visa, you will need to provide a court letter, which is essentially a document from the court stating that the company is unable to cancel your visa.
This letter will serve as proof to the authorities that you have taken all necessary steps to cancel your visa and that it is not possible due to the company's financial situation.
As for the NOC, it is not specifically mentioned in the law as a requirement for visa cancellation. However, some authorities may request it as an additional document to support your case.
If you have an NOC from your employer, it is advisable to submit it along with the court letter.
It is important to note that the cancellation of your visa may take some time, as it involves multiple steps and approvals from different authorities. Therefore, it is best to be patient and follow up regularly with the relevant authorities until your visa is canceled.

Greetings,
Dear Questioner,
The court letter mentioned by the Free Zone Authority likely refers to a legal document that confirms the termination of your employment contract and the company's inability to fulfill its obligations.
This document would serve as evidence to support your request for visa cancellation.
While a formal NOC (No Objection Certificate) is typically required for visa cancellation, in this specific case, the court letter might suffice as proof of termination, especially if the company is unable to provide an official NOC due to financial or operational issues.

Dear questioner,
During the hearing call with MOHRE, you need to raise the concern about canceling the visa and explain that the company is no longer operational, so the visa should be canceled, and an NOC issued for further visa proceedings.
