Can my brother travel outside the country if he filed a case against assault?

My brother is the victim of 2 attackers.

We filed the case and the case is in court but while we're waiting for the next hearing/process, his health is getting worse.

So is it possible for him to travel outside Dubai back to his home country while the case is pending?

Generally, individuals involved in legal proceedings, especially as victims, are not restricted from traveling unless the court has issued any specific orders, such as a travel ban or a requirement to remain available for the case.

It will be applicable only, if the court has issued specific orders.

If you need further clarification you may ask.

Yes, it is possible for your brother to travel back to his home country while the case is pending, but this will depend on whether there are any travel restrictions or court orders preventing him from leaving.

If your brother's health condition is deteriorating and he needs to travel for medical reasons, he can request permission from the court to travel.

The court may allow him to leave if it is convinced that his medical needs require it, but this depends on the judge's discretion and the specific circumstances of the case.

You can check with the relevant authorities (such as the Dubai Public Prosecution or the Court handling the case) to verify if there is any travel ban currently in place for your brother.

I'm sorry to hear about your brother's situation and his declining health.

In the UAE, individuals involved in ongoing legal proceedings, especially as victims, are generally not subject to travel bans.

However, if your brother has been summoned as a witness or is required to attend court sessions, his presence might be necessary.

Given his health concerns, it's advisable to:

Obtain Medical Documentation: Secure detailed medical reports from a licensed physician outlining his condition and the necessity for treatment abroad.

Communicate with Legal Authorities: Present these medical documents to the court handling the case. The court may grant permission for him to travel, considering his health needs.

Coordinate with Legal Representation: Ensure that his legal counsel is informed and can represent his interests during his absence.

I recommend scheduling a consultation to discuss the specifics of your brother's case and to assist in facilitating the necessary permissions for his travel.

Please feel free to contact me via WhatsApp or phone to discuss this further.

Best regards,

Suhail Rana
