Should I work the 30-day notice if my visa expires in 18 days after my contract ended?

Dear Lawyers,

My contract expired on the 21st of October, and on that date, I informed my company that I would not be renewing it.

Should I work during the 30-day notice period when my residence visa expires on the 8th of November?

Dear questioner,

As per the procedures, you should serve the notice period before the contract expires if you do not wish to renew it.

However, it is mandatory to either serve the notice period or compensate the company by making a payment in lieu of it.

You may also negotiate with your company regarding this.

Hello,

According to UAE Labour Law, when either the employer or employee decides not to renew a fixed-term contract, the notice period is usually 30 days unless otherwise agreed upon in the contract.

Since your contract expired on October 21st, and you informed your company on that day that you will not be renewing it, you are required to serve the 30-day notice period unless you and your employer mutually agree to waive this.

If your residency visa is tied to your current employer, once your employment relationship ends (i.e., when your contract expires and you leave or complete your notice period), your visa will also expire.

If your visa is expiring on November 8th, you must ensure that your visa status is managed appropriately during the notice period.

After completion of the contract, you have 30 days grace period time.

Dear Questioner,

The UAE Labor Law mandates a minimum notice period of 30 days for both employers and employees, unless otherwise specified in the employment contract.

Since your residence is going to expire on the 8th of November, you will have a minimum grace period of 30 days.

Communicate with your HR department or management to discuss the necessary steps to comply with the notice period.

If you need further clarification, please feel free to ask us.

Hello!

A 30-day notice period is not required after the expiration of the contract. The employer is obligated to cancel your visa if you have submitted a request for non-renewal of the contract.

Thank you for reaching out with your question!

Since you informed your company of your decision not to renew your contract upon its expiration on October 21st, you generally have the right to work the standard notice period of 30 days unless both parties agree otherwise.

However, your residence visa expiring on November 8th adds a layer of complexity.

Typically, your company should either renew your visa temporarily or adjust the terms of your final working days to align with the visa expiration. This ensures you can complete your notice period without any legal issues.

I recommend discussing this matter further, as your rights and obligations depend on your contract specifics and UAE labor law nuances.

Feel free to reach out to me on WhatsApp or phone at [----------] so we can explore your options in detail.

Best regards,

Suhail Rana
