Questions & Answers
New landlord demands immediate eviction or rent increase without notice. What are my options?
Dear Lawyers,
I did not receive an Ejari from my previous landlord. The new landlord has sent me an email requesting that I vacate immediately without notice or pay rent according to the current market rate.
What are my options in this case?
Dear Questioner,
It's important to understand that landlords in Dubai cannot force you to vacate without proper notice. If it's in Dubai, then the landlord must serve a 12-month eviction notice for the reason of sale.
Otherwise, there is no need to vacate the property.
If you need further clarification, we will discuss the possibility further. Kindly share your WhatsApp number to discuss this further.
Hello,
Your lease agreement is a legally binding contract. It outlines the rights and obligations of both the tenant and landlord.
Most lease agreements require a specific notice period for termination. While landlords may cite market conditions to justify adjustments in rent or other terms, they typically cannot unilaterally terminate a lease without following legal procedures.
Immediate eviction without notice or legal justification can be contested. The landlord must follow proper eviction procedures as per UAE rental law.
You can file a complaint with the Dubai Rental Disputes Center (RDC) for violation of the lease terms and lack of proper notice for eviction.

Hello,
If your property is in Dubai, it’s important to note that having an Ejari is not mandatory, as the tenancy relationship can be established through all available forms of evidence.
Regarding the email from your new landlord requesting an immediate eviction, the law specifies certain grounds and conditions under which eviction is permissible, and these must be met to proceed with any eviction request.
If the landlord has not issued an official eviction notice, there’s no need for concern; you should continue occupying the property and ensure timely payment of rent.

Hi,
Good afternoon!
If your new landlord is requesting you to vacate immediately without notice, UAE tenancy law requires a landlord to provide a notice period for eviction, typically 90 days for non-renewal or termination of the tenancy.
The landlord must also specify valid reasons for termination, which usually include non-payment of rent or breach of contract terms.
The landlord’s reference to the current market situation does not inherently provide grounds for immediate eviction.
They cannot unilaterally change the rental agreement without following the legal process.
If the new landlord insists on immediate eviction or fails to follow proper procedures, you can file a complaint with the Rent Committee at the Dubai Land Department or the relevant authority in your emirate.
