What to do if the bank is pursiung me to pay after a criminal case and paying?

Dear Inquirer,

In 2018, the bank filed a criminal case against me for my unpaid credit card balance.

The court ordered me to pay it and I did pay it thru the court.

Now the bank is pursuing me again to pay the said amount.

Please advise

Hello,

If your issue involves a bounced cheque or a cheque that was returned due to insufficient funds, under the old law, the bank could file a criminal complaint at the police station to obtain a judgment against you as a penalty for issuing a cheque in bad faith.

However, following recent amendments to the laws on cheques, the creditor now has the right to file cheque execution to claim the unpaid debt or the value of the cheque, as the criminal and civil aspects are treated separately.

I would advise you to attempt negotiations with the bank if you have not settled the actual debt yet. If you have already paid the amount in full, you can approach the court to object to the bank's current claim.

Check with your bank first to ensure the amount is the same.

If it's not the same amount you can file a complaint against them because they are bothering you.

You can prove that you have paid the amount owed to you, then send a legal notice to the bank explaining your position and paying the financial dues by depositing them in court and warning them not to claim those amounts, otherwise, you will take the necessary legal action.
