How can I expedite my unpaid salary claim after filing a police complaint?

Hello,

I was employed by a company in 2017 that failed to pay my salary. I was given cheques, which eventually bounced. I registered a complaint with the police in May 2018.

However, I have not received any notification or compensation yet. I would like to know if there is any way to expedite the process.

Hello,

The police will only address the criminal aspect of issuing a cheque without sufficient funds; they will not be able to recover your financial entitlements.

In such cases, you should have filed a labor case to claim your employment rights, including your unpaid salaries.

At this stage, you can still open an execution case for the bounced cheques you hold. This process allows you to enforce the recovery of the cheque amounts through legal means.

Please provide the relevant documents, such as the bounced cheques and any supporting materials, so that I can guide you more precisely on the next steps.

You must submit a complaint to the Ministry of Human Resources and Emiratisation.

Hello,

Thank you for reaching out!

I understand the frustration of not having received your rightful compensation, especially with bounced cheques involved.

In your case, since the complaint was lodged in 2018, there are legal avenues to expedite the matter.

It is possible to pursue both criminal and civil actions for cheque bouncing, and depending on the specifics, the case may be moved to court for further execution.

Additionally, there may be options to escalate the process through the Dubai Courts for enforcement.

I would be happy to assist you in reviewing the current status of your case and advise on the most effective steps to ensure a quicker resolution.

Please feel free to reach out to me on WhatsApp or phone at [---------], or via email at at [---------], and we can discuss the next steps.

Best regards,

Hello dear questioner,

If you submitted a complaint to Human Resources within a year of your resignation, the complaint would be referred to the court to become a case, allowing you to claim your entitlements.

We can assist you with that, but we need more details.

Please share your WhatsApp number for more information.

Hi,

Good morning!

According to UAE law, non-payment of salaries is considered a criminal offense and can result in penalties for the employer, including fines and imprisonment.

In your case, since you have already registered a complaint with the police, the next step would be to file a case with the Ministry of Human Resources and Emiratization (MOHRE).

You can do this by submitting a complaint through their online portal or by visiting one of their offices.

Once your complaint is received, MOHRE will investigate the matter and try to reach a settlement between you and your employer.

If a settlement cannot be reached, they will refer the case to the court for further legal action. It is important to note that the process may take some time, as it involves legal procedures and court hearings.

To expedite the process, you can also connect our lawyer who can represent you and help you navigate the legal system. They can also assist in negotiating a settlement with your employer.

In addition, you can also file a civil case against your employer for the bounced cheques. This can be done through the court system and may result in your employer being ordered to pay you the outstanding salaries and any other compensation deemed appropriate by the court.

It is recommended to seek legal advice and assistance to ensure your rights are protected and to expedite the process.

For further assistance, kindly share your contact details.
