I resigned with a 90-day notice. Can my company withhold my salary or deduct visa costs?
Dear Lawyers,
I finished my 2-year contract last April and renewed it for another 2 years starting in May. I submitted my resignation in September with a notice period of 90 days (3 months) until December.
Is my company entitled to withhold my salary for any month or deduct any type of visa costs from me?

Hello,
If you have provided a 90-day notice in accordance with your contract, you are fulfilling the requirement and are entitled to receive your full salary during this notice period.
Your employer cannot withhold your salary without a valid legal reason; salary must be paid for work performed unless specific contractual provisions allow for deductions.
Additionally, employers are prohibited from deducting visa costs or other expenses unless such deductions are explicitly stated in your employment contract and agreed upon by both parties.
Upon resignation after completing your contract, you may also be entitled to end-of-service benefits, calculated based on your length of service.

Dear Questioner,
From your explanation, after finishing your two-year contract, you renewed it for another two years, and now you need to terminate the contract before its expiry.
The company cannot withhold your salary for visa expenses if nothing specific is mentioned in your employment contract. You should verify the termination clauses in your contract to ensure this.

Hi, Good afternoon,
According to UAE labor law, your employer is not allowed to hold your salary or deduct any visa costs from you without your consent.
As long as you have fulfilled your contractual obligations and given the required notice period, your employer is obligated to pay your salary for the months you have worked.
However, if there are any outstanding debts or expenses that you owe to the company, they may deduct those from your final settlement.
This could include any loans or advances given to you by the company, or any damages caused to company property.
It is important to review your employment contract and any other agreements you have signed with your employer to understand your rights and obligations.
If you have any concerns or disputes, you can seek legal advice from us.
