Questions & Answers
The tenant left before the end of the eviction notice period. Can I re-rent the property?
Dear Lawyers,
I gave a legal notice to my tenant to vacate the property as I intended to use it for personal purposes. He vacated the property before one year on his own accord.
Can I rent the property again, as my circumstances have changed and I no longer wish to use it for personal use?
Greetings,
After a year of his departure, you can change the intention of course and you can rent him again.
We are honored to provide you with legal support.

Hi,
Good Morning!
According to Article 26 of the UAE Tenancy Law, if the landlord has given a valid notice to the tenant to vacate the property for personal use and the tenant has vacated the property, the landlord is not allowed to rent the property to another tenant for a period of two years from the date the tenant vacated the property.
This is to protect the tenant's rights and give them time to find a new place to live.
If there has been a change in your circumstances and you no longer need the property for personal use, you can approach the tenant and offer to rent the property to them again.
If the tenant agrees, you can enter into a new tenancy agreement with them. However, if the tenant does not agree to rent the property again, you will have to wait for the two-year period to expire before you can rent the property to a new tenant.
Renting the property before the two-year period is over can result in legal consequences and the tenant may have the right to claim compensation.
It is important to note that any changes in the tenancy agreement, including the reason for the tenant vacating the property, should be documented and agreed upon by both parties to avoid any legal issues in the future.
It is recommended to seek legal advice before making any changes to the tenancy agreement.

Dear Questioner,
If you evicted the tenant on the grounds that you (or a first-degree relative) needed the property for personal use, you are legally restricted from re-renting the property for a specific period.
You cannot lease the property to a new tenant for 2 years (for residential purposes) or 3 years (for commercial purposes) from the date of eviction.
This is to prevent landlords from using the personal-use claim as a pretext for evicting tenants and then re-renting at a higher rate.
If your circumstances have changed and you no longer need the property for personal use, the law requires you to abide by the 2-year (or 3-year) restriction once you’ve evicted a tenant for this reason.

In this case, the tenant can file a compensation claim against you.

Dear questioner,
If we have enough proof that the tenant left the apartment of his own accord, then we have a good defense even if your previous tenant is causing some issues.

Dear Questioner,
Thanks for your inquiry!
According to Article 26 of the UAE Tenancy Law, if a landlord gives a tenant a notice to vacate the property for personal use and the tenant leaves before the end of the tenancy contract, the landlord is not allowed to rent the property to another tenant for a period of two years.
However, if there is a change in circumstances and the landlord no longer needs the property for personal use, they can rent it out again after obtaining approval from the relevant authorities.
This approval may require providing a valid reason for the change in circumstances and may also involve paying a penalty.
