Q: I work for a company in IMPZ Dubai. I resigned on June 23 & my last working day was on July 22, 2018. My employer has not paid 2 months' salary & gratuity till date.
The company forcefully asked me to sign the cancellation paper and my visa got cancelled on August 16.
I have an email from the vice president of the company dated August 24 confirming that my settlements will be paid soon, and they mentioned in my settlement calculation that my dues will be paid upon visa cancellation, as this is their company policy.
Few other employees have left the company recently & the management followed the same process. i.e. visa cancellation first and then settlement of dues.
Kindly advise, how can I get my rights?

Claiming unpaid salaries and entitlements for arbitrary termination
3
Q: Labor Case
I have not been paid 4+ months in salaries of 40,500. I have served in the company 5.8+ years to date. I am due to pending salaries, leave salaries for 51 days, gratuity and a personal balance of 54,000.
My present company has been sold to another company and I have been requested to continue my job at a lower salary and demoted from my current position of General Manager which are terms of arbitrary termination.
I have refused to sign stating I will not do so until my pending salaries and dues are settled. They have not terminated me nor have I resigned from my current position as I believe they are not legally authorized too.
They have not transferred the TL to their names yet. However, they are sitting in our office and making transactions on behalf of the company and operating the bank accounts.
The previous owner is unreachable both by email and phone.
As per the above, what are my options to claim?

Arbitrary dismissal for requesting the payment of delayed salaries

Q: Dear Ma'am
Good day to you,
I am working in a company where they didn't pay me for 5 months and I have asked them to do so, in order to leave for marriage on August 26, 2018 (Please note my visa expires on 18/09/2018).
But the response from them was swift and fast and they gave me a letter of termination with notice period 30 days. I have refused to sign the letter.
The company is not in a position to settle my outstanding salary gratuity and leave salary at the moment, as I have been informed so verbally.
So shall I file a case and tell the labour office to hold it till I come back from my marriage, one day before my visa expires? is that possible?
Thanks in advance for your advice.

Failure to settle EOSB after resignation for pending salaries
9
Q: I resigned from my job at a company in Aug. 2018 and completed my one month notice period, then joined a new company in November 2018.
The reason for the resignation was that the company didn't pay the last 4 months' salaries. The company promised me that time they will pay my settlement and pending salaries later.
They gave me only a total settlement paper mentioning my pending salaries and the final end of service settlement.
Then I sent the company daily emails to clear my settlement and they only gave me AED 10,000 in January 2019. There's still a balance of AED 38,697 now.
Can I file a complaint in the labour department against my company?
Please advise if there's any other easy solution.
Thank you.

Claiming last month salary after signing the cancellation papers
4
Q: Good day,
I resigned from my company with a 1-month notice until December 31, 2019.
My company accepted my resignation but had requested me to extend working with them till January 28, 2020. I agreed but had asked my company to pay my end of service till Dec 31, even I'm still working, since I need to settle my loans before going back to my home country.
They told me that my salary for January 1-28 will be given only once I complete my extension. I already signed the visa cancellation and work permit papers even I didn't receive my remaining salary yet. My visa And work permit was already canceled on January 26.
When I followed up for my 28 days salary with HR, they have no response and ignored me. I raised a complaint with the Ministry of labor. We have scheduled a hearing tomorrow Feb 1. What will I do if the employer did not appear on the scheduled hearing?
Thank you!

What does it mean if my MOHRE complaint about my unpaid salary is closed?

1
Q: Hello,
I filed a MOHRE complaint against my former boss for my September 2024 salary. It shows as closed on the MOHRE website.
What does that mean? I am currently outside the UAE; can my former boss still pay me?

Legal remedy for non-compete suit filed by ex-employer 1
Hi,
I have signed a non-compete clause (under unlimited contract) with my previous company. After working for 8 years with them, they terminated me.
I have now joined a competitor considering there was no other job available in the market. Now after 7 months, my previous company has filed a legal suit asking for compensation considering I am in a similar role and in the same territory.
What is the available remedy?
