Defaulting on credit card payment and subsequent civil case
Dear Sir
I am a Dubai resident.
Last month, Mashreq filed a criminal case against me for credit card cheque bounce of AED 60000. I paid the fine and got released from the police station.
Now, they called me again and said they are going to file a civil case against me. If they file a civil case, will there be any immediate travel ban?
Also, advise if the police can arrest me on the basis of this civil case immediately.

Dear Sir/ Madam,
Thank you for getting in touch with me on this.
Considering the bank has already bounced your cheque, filed a police case and you have cleared the case, the criminal liability is disposed off.
Now, the bank has an option to file a civil case against you to claim its dues i.e. AED 60,000/-.
Responding to your query- No there will not be an immediate travel ban against you, and no, the police will not arrest you for this civil case as soon as the case is filed.
However, the law does provide a tool to apply for travel ban in a civil case and this is called an "Urgent Case", wherein a party (bank) may apply to put a travel ban on you for the reason that you might be at a fleeing risk.
This application is at the discretion of the judge and not likely to be granted. However, it is possible in law.
With my limited experience, I have not come across any court granting a travel ban for such an amount, however, you ought to know the law.
I would advise that you get in touch with the bank and settle your debt. Since they don't have the pressure of criminal case, you might be able to negotiate for a good discount.
I trust you find this helpful. You may get in touch with me on 052-9495731 for further assistance and clarification.
