Can I execute a Dubai judgment in Sharjah, or is it restricted to Dubai?

Dear Lawyers,

I have a question regarding the execution of a judgment. I filed a civil case in Dubai against someone who works and resides there, and I received a judgment in my favor.

Can I open an execution case in Sharjah based on that judgment, or does it have to be in Dubai only?

If I can open it in Sharjah, on what grounds can I do so?

You cannot pursue the case in Sharjah. The judgment is in Dubai, so the execution must be in Dubai.

No, you can only open the case in Dubai, as the judgment was issued there. It’s impossible to open it in Sharjah.

Dear Questioner,

Generally, judgments issued by Dubai courts can be enforced across the UAE, including Sharjah.

To open an execution case in Sharjah based on a judgment obtained in Dubai, you can do so through the Sharjah courts' Execution Department.

This is done in accordance with the reciprocal enforcement of judgments among the emirates in the UAE.

Grounds for opening an execution case in Sharjah on a Dubai judgment can include the defendant's assets being located in Sharjah, or if the defendant resides or works in Sharjah, among other factors.

It is essential to consult with a legal professional personally to ensure the correct procedures are followed in opening the execution case in Sharjah.

Dear Questioner,

Each Emirate has its own legal system and courts, and judgments are typically enforceable only within the jurisdiction where they were issued.

To execute a judgment, the debtor must have assets within the jurisdiction where the execution is initiated.

If the debtor's assets are primarily in Sharjah, you might consider exploring options to execute the judgment there, but this would require some procedures.

Kindly share your WhatsApp number to discuss this further.

Dear Questioner,

Yes, you can enforce a judgment issued in Dubai in Sharjah.

According to UAE laws and procedures, judgments can be enforced in any emirate other than the one where the judgment was issued. Here are the steps you should follow:

- File for Enforcement:

You need to file a request for enforcement at the Execution Court in Sharjah. You will need to submit a copy of the judgment from the Dubai court, along with any other relevant documents related to the case.

- Verify the Judgment:

Ensure that the judgment from Dubai has been certified by the relevant authorities, such as the Ministry of Justice or the Court of Appeals if required. This may involve obtaining a certificate of authenticity and documentation of the judgment.

- Legal Basis:

Judgments issued by courts in other emirates can be enforced in any other emirate. You simply need to submit a request to the Execution Court in the emirate where enforcement is sought.

- Enforcement Procedures:

After submitting the request to the Execution Court in Sharjah, the court will verify the judgment and initiate the necessary enforcement procedures in accordance with local laws and regulations.

If you need specific legal assistance with filing the enforcement request or with the procedures related to the judgment, you can contact us for specialized legal advice.
