Would a judge accept a 5% initial payment for an installment request?

Dear Lawyers,

I won a case against an individual, and the amount awarded is around 250. He has requested to pay 5% now and the rest in installments.

Do judges accept this? I have heard it has to be a minimum of 30% as the initial payment for an installment request to be accepted.

Dear Questioner,

Ultimately, the decision to accept a payment plan for a court-ordered judgment lies with the judge handling the case.

While there is no strict rule stating that the initial payment must be at least 30% for an installment request to be accepted, judges may be more inclined to approve a payment plan that includes a substantial initial payment.

It is possible that the judge may require a larger initial payment, especially if the total amount awarded is relatively low.

However, the judge may also take into consideration the financial circumstances of the individual against whom the judgment was awarded and may be willing to accommodate their request for a lower initial payment.

Ultimately, it is up to the judge to weigh the facts of the case and determine an appropriate payment plan.

It may be helpful to consult with an attorney or seek guidance from the court on what options are available in your specific situation.

It depends on the judge who accepts it or not.
