Removing a deportation order for possession of drugs

Hi,

My fiance was arrested due to drug possession.

The prosecutor in Dubai dropped the charges and ordered deportation after 30 days being in jail, so he doesn't have an order for deportation from the court as he didn't go to the court.

What are the chances for him to get back to the UAE as he has a good job offer and what is the procedure to do that?

Dear Sir/ Madam,

Thank you for getting in touch with me on this.

At the outset, it is very fortunate that your fiance does not have a deportation order from the Court as there was a possibility that he would've been exposed to a stringent punishment by court.

As mentioned by you that he was detained for 30 days and charges were dropped, there are good chances that he will be able to come back to the UAE.

However, I would not suggest that he travels without making an inspection of immigration record.

The reason why I suggest this is that there is a possibility that his name might be on the blacklist, hence making travel arrangements (spending on tickets and visa) and then being denied to enter will be financially burdensome for you and him.

You must conduct an immigration check to understand if there is any travel restriction on him. If its all clear, then 100% your fiance can travel back to the UAE and start afresh.

Thank you for your prompt response.

We are expecting that he is blacklisted, therefore we want to know what is the procedure to remove his name from the list and whom should we contact in that case.

I know we should deal with immigration but what is the procedure as he was told he should wait 3 months after the day of deportation.

If the first step is to check, we will hire the lawyer for sure but I want to know what are the steps afterwards if he is blacklisted.

Dear Madam,

Yes, the first step will be to understand the Immigration Status of his travel i.e. if he has blacklist or no.

As indicated to you previously that he should wait for three months, there are chances that he is not blacklisted. If there is no blacklist, then the step to remove does not arise.

Depending if there is a blacklist and the reason is drug possession, then you will have to again get in touch with the public prosecutor and liaise with the Immigration office.

To be very honest, removing a person's name from the blacklist is a lengthy and tedious process and does not mean it will happen for sure.

However, I would like to believe there is no harm in trying.

I would still recommend checking the immigration status to understand the nature of blacklist if any.
