What are my labor dues after resignation if I worked for a company for over 7 years?

I have worked for a free zone company for over 7 years. The company provided me with a share and changed my visa from a Fujairah free zone to a Dubai free zone during the 7-year duration.

My salary has changed from 6.5k to 25k in these 7 years. If I resign, I am aware I'm entitled to some benefits.

Can I have any guidance on this?

Hello,

Dear questioner, you can claim the end-of-service reward, which is one month for each year, except for the basic wage in the contract, that is, without allowances and in-kind benefits.

Dear Questioner,

Thanks for your inquiry.

Regarding the above, we would like to inform you that, according to UAE labor law, an employee who has completed one or more years of continuous service is entitled to end-of-service benefits upon resignation.

The amount of end-of-service benefits depends on the length of service and the employee's last salary.

In your case, since you have worked for over 7 years, you are entitled to the following end-of-service benefits:

1. 21 days of basic salary for each year of the first 5 years of service

2. 30 days of basic salary for each additional year of service after the first 5 years

Your basic salary for the calculation of end-of-service benefits will be your last salary of 25k. Therefore, your total end-of-service benefits will be calculated as follows:

(21 days x 5 years) + (30 days x 2 years) = 105 days + 60 days = 165 days of basic salary

In addition to the end-of-service benefits, you are also entitled to receive any unused annual leave days and gratuity pay for the current year.

It is important to note that if you have any outstanding loans or debts with your employer, they have the right to deduct these amounts from your end-of-service benefits.

It is recommended that you consult with your HR department or a legal advisor for further guidance and to ensure that you receive all the benefits you are entitled to upon resignation.

Kindly feel free to contact us by phone or email for further inquiry.

Greetings

Certainly!

When resigning from a company in the UAE, especially after working for seven years and experiencing changes in your salary and visa status, it's essential to understand your entitlements and benefits.

Here's a general overview of what you may be entitled to upon resignation:

1. End-of-Service Gratuity (ESG): As per UAE labor law, employees are entitled to receive an end-of-service gratuity payment upon completion of one year of continuous service. The gratuity amount is calculated based on your final basic salary and the length of your service. For each year of service, you are entitled to receive a certain percentage of your basic salary. This percentage typically ranges from 21 days' salary for the first five years of service to 30 days' salary for each additional year of service thereafter.

2. Unused Annual Leave: If you have accrued unused annual leave days, you may be entitled to receive payment for these days upon resignation. The value of unused annual leave days is calculated based on your daily wage.

3. Notice Period: Depending on your employment contract and company policies, you may be required to serve a notice period before resigning. If you do not serve the full notice period as per your contract, your employer may deduct the equivalent salary from your final settlement.

4. Airfare Allowance: Some companies provide employees with an airfare allowance or ticket reimbursement upon resignation, especially if you are returning to your home country. Check your employment contract or company policies to see if you are eligible for this benefit.

5. Other Benefits: Depending on your contract and company policies, you may also be entitled to other benefits such as medical insurance coverage until the end of the notice period, settlement of outstanding salary or expenses, and any other contractual entitlements.

Before resigning, carefully review your employment contract, company policies, and UAE labor law to understand your entitlements and obligations.

It's also advisable to discuss your resignation and settlement terms with your employer to ensure a smooth transition and settlement process. If you have any questions or concerns, consider seeking advice from a legal expert or labor consultant familiar with UAE labor law.

According to UAE labor law, employees who have completed one year or more of continuous service are entitled to end-of-service benefits upon resignation. The end-of-service benefits include gratuity pay, which is calculated based on the employee's basic salary and length of service.

In your case, since you have worked for over 7 years, you are entitled to gratuity pay for the entire duration of your service.

This means that you will receive gratuity pay for the first 5 years at a rate of 21 days of basic salary for each year and for the remaining 2 years at a rate of 30 days of basic salary for each year.

In addition to gratuity pay, you may also be entitled to other benefits such as unused annual leave, notice period pay, and any other contractual benefits as per your employment contract.

It is important to note that if you signed a new employment contract with your company when your visa was changed from the Fujairah free zone to the Dubai free zone, your gratuity pay may be calculated based on your basic salary at the time of the new contract.

Hello dear,

The worker is entitled to an end-of-service gratuity upon the end of his service, a leave allowance for unused days, and a travel ticket only if he returns to his country.
