Questions & Answers
Can I ask the court for maintenance reduction after leaving for home country with less salary?
Hi
My wife has filed a maintenance case in Abu Dhabi.
Now after the judgment, what are the possibilities that I can permanently return to my home country?
If I go back to my home country, will the maintenance amount go down as my salary will be less in India?
Please suggest.
According to UAE law, if your wife has filed a maintenance case in Abu Dhabi and the judgment has been issued, you are required to comply with the court's decision and pay the specified maintenance amount.
If you choose to permanently return to your home country, you will still be responsible for paying the maintenance amount as ordered by the court.
But we can apply for an appeal for you and ask the court to review the decision.

If there is no travel ban against you, you can return to your home country, India.
As for the ordered expenses, they only change based on a new ruling, and your return to India does not automatically mean that the expenses will be reduced.
You must file a claim requesting a reduction in expenses due to a change in your circumstances.
You will be entitled to file the new lawsuit one year after the issuance of the current ruling.
To reduce your maintenance amount, you must file a new request to the court.
If the judge approves this request, then it will be reduced. Otherwise, no the Maintenance amount will stay the same.

If your wife has filed for a maintenance case in Abu Dhabi and a judgment has been issued, there are several factors to consider regarding your return to your home country and any potential changes to the maintenance amount:
1. Legal Obligations: It's essential to understand your legal obligations as determined by the court judgment. If the court has ordered you to pay maintenance to your wife, you must comply with the court's decision until any modifications or changes are legally approved.
2. International Enforcement: Court judgments, including maintenance orders, may have provisions for international enforcement. Even if you return to your home country, the court judgment may still be enforceable, and your wife could potentially pursue legal action to enforce the maintenance order through international legal mechanisms.
3. Modification of Maintenance: If there are substantial changes in circumstances, such as a significant decrease in your income due to relocating to your home country, you may be eligible to petition the court for a modification of the maintenance amount. However, any modification would need to be legally approved by the court after considering all relevant factors.
4. Consultation with Legal Counsel: It's advisable to consult with a legal expert or attorney who specializes in family law and international matters. To provide personalized advice based on your specific situation, including the implications of returning to your home country and any potential adjustments to the maintenance amount.
5. Communication with Your Wife: Open and transparent communication with your wife regarding your intentions, financial situation, and any proposed changes can help facilitate understanding and potentially negotiate any modifications to the maintenance arrangement, if appropriate.
Overall, navigating international family law matters can be complex, and it's crucial to seek professional legal guidance to ensure compliance with legal obligations and protect your rights and interests.
Greetings,
As long as you pay your alimony regularly, you can return to your country, India, and work there, and send them alimony according to your means.
Everyone spends according to their ability, and Allah does not charge a soul except with that within its capacity. To avoid the travel ban, pay your alimony regularly before you travel.
