Q: My sister lives in Dubai. Her husband was convicted of murder and served time in jail for murdering their maid.
Yesterday, he tried to suffocate and kill my sister. She went to the police station and a hospital. He changed the locks on the door so that my sister can't come back home and be with her children.
He's also taken her passport and ID. She's in fear for her children. She's also in great fear of her life. She believes that if she goes back to him, he will kill her like he killed their maid.
She wants to go back to her family in Morocco and wants to bring her children with her so that they will be safe. Would she be able to go to Morocco with her children?
The law of Dubai protects women and children from abuse, and as such, the children should not be left with a convicted murderer and should be returned to their mother.
My sister should have the right to go back to her mother and father, to the safety of her family, with her children so that they can all finally be safe.
Please help!

Is it possible to file a case of maintenance without a divorce?
6
Q: Assalam Alaikum,
I am French and have 4 children, and I am 3 months pregnant.
I reside in the UAE and my husband clearly stated that he is leaving for Turkey because life is less expensive than the UAE and that I will have to pay all the bills here by myself and take care of the kids as I am working here.
What can I do? What about when the baby will be born?
All my children are under my residency (iqama) Alhamdulillah but will I be able to add my baby under my iqama knowing that the father abandoned us and we are not legally divorced?
Jazakum Allahu Khairan for your answer.

The rights of the wife for maintenance and residency after divorce
3
Q: Hi,
I am living in the UAE with my husband. (We're married Islamically). We moved to the UAE for a job opportunity for him and I followed, giving up my career.
We have been separated for 4 months but still living together in separate rooms. The plan was to try to work on ourselves and move forward.
When we first moved to the UAE, it was challenging for me to find an opportunity in my studied field and I went into another profession. I have recently put in my notice at my job for the betterment of what's left of my marriage.
I planned to find another job in the coming months. Two months ago I found out that my husband cheated and has been involved with another woman.
As I am under his sponsorship (residency), do I have rights in the UAE should we get divorced?
That is to stay, look for another job or for him to pay a sort of maintenance to me until I find another job?

Can my husband demand a separate device for our child, and could it affect my parental rights?

1
Q: Hello,
My husband and I are married and have a 6-year-old child. Due to ongoing disputes, he is demanding that I get a separate device and SIM card for our child so that he and his family can contact the child without using my number.
He has also instructed his family to block me and communicate only through a separate number, claiming that I do not facilitate enough communication with them.
I have never prevented anyone from contacting our child, and I will still be the one managing the device and calls. Does he have the right to impose this unreasonable demand on me?
If I comply, could this set a legal precedent that might impact my parental rights in the future?

Can the owner of a company escape if there is a cheque execution and travel ban on him? 0
I raised a cheque execution case against a company and its owner and won. There is a travel ban on him. I was receiving installments for three months and now he stopped paying.
The court after request summoned him. In total, he paid only 30% of the owed money. I found that his company license is expired and also in the month his visa will expire.
Does he have any option to avoid payment?
Please note he was deceived by showing no money in his bank account and no assets in his name but he is running multiple businesses.
Also a month ago, he tried to convince me to lift the travel ban but I refused to do so. But he submitted a guarantee and left UAE.
Now the status shows he is back in the UAE and the travel ban imposed again. But after that, he stopped payment.
Is there a 1% chance of him not paying me the remaining money?
Is there a way he can leave the country through the Amnesty program or any of this sort?

Can a developer demand extra payment for a 30% size increase after handover? 0
Hello,
I purchased a one-bedroom off-plan unit in Dubai from a well-known developer under an SPA specifying an area of 801 sq. ft. I completed all payments as per the developer’s payment plan, and the unit was handed over to me without a Title Deed.
After taking possession, furnishing the unit, signing a tenancy contract, and making repeated follow-ups to obtain my Title Deed, the developer informed me, 45 days after handover, that the actual area was 1,041.41 sq. ft., a 30% increase from the original SPA terms.
To receive my Title Deed, they are now demanding payment for the increased size.
Key issues:
- Failure to notify me before handover about the 30% increase in area.
- The SPA allows for price adjustments for area variations but specifies that such adjustments must be reflected in the final installment, which I had already fully paid before handover.
- The developer has now filed a legal case through Dubai Courts, demanding payment.
I require legal advice based on RERA/DLD laws and the SPA.

View allMy landlord increased my rent more than RERA Index and refused my offer and deposit. What to do? 0
Good morning,
My landlord notified me 90 days before my contract’s end of a 15% rent increase, raising it from AED 55,000 to AED 63,250. However, according to the RERA index, the maximum increase should be 5%. I tried to negotiate, but they refused.
On October 15, I made an offer and deposit of AED 57,250 (including the RERA-approved increase). The judge accepted it, but the landlord rejected it, claiming their other 1-bedroom units rent for AED 75,000.
My contract expired on October 31, 2024. Recently, the landlord emailed saying I’m now staying illegally and will be charged AED 100 per day for not signing a new contract.
Last week, I requested a new contract based on the RERA index, but they responded by refusing my offer and deposit, demanding full payment.
My question:
Should I be concerned, or should I let them pursue a case?
Or just wait and see?
Thank you for your assistance.

The landlord insists on increasing the rent more than RERA Index. What can I do? 0
Hi everyone,
I’m facing an issue with my rental situation and would appreciate any advice.
I purchased a company in July that’s renting a shop space, and the tenancy contract (under the company’s name) is ending on November 22.
The landlord is insisting on a 40% rent increase, even though the RERA Index clearly indicates a 0% increase for this area.
I’ve informed the landlord that this increase isn’t in line with RERA regulations, requested a new contract, and asked him to come by to collect the cheques—but he’s been unresponsive.
To protect our position, I filed an offer and deposit with the rental dispute center, but it was automatically closed because the landlord didn’t respond.
My question is: what should I do next?
Filing a case for renewal will cost 5% of the rent, which is a significant amount right now.
Are there any alternatives to proceed without incurring that cost, or any other steps to ensure the landlord adheres to the regulated rental terms?
