Dear Questioner,

The employer should not be compensated because the costs of accommodation and recruitment are the employer’s obligations.

Hello,

The UAE Labor Law does not allow the employer to collect visa fees from the worker for any reason unless this is agreed upon between the two parties in the contract.

However, the employer may demand that the new employer to which the worker has moved pay for the recruitment costs, and this occurs according to the agreement.

Therefore, you should review your employment contract for further clarification.

Dear Questioner,

According to UAE labor law, an employee is not required to compensate the employer for visa costs if they resign during the probation period.

However, the new employer is required to pay the visa cost.

Dear Questioner,

If the employee resigns during the probation period and moves to another job, the new employer must pay the cost of recruitment and visa to the old employer, unless there is another agreement between the worker and the employer.

The employee should not compensate for visa costs. The responsibility should lie with the new employer, but ultimately, it can be negotiated with the current employer.

Under UAE labor regulations, an employee is not obliged to reimburse the employer for visa expenses upon resignation during the probationary phase.

Nonetheless, if the employment contract specifies or if the employee has agreed to repay visa costs, the employer can deduct these from the final settlement.

It's crucial for both parties to explicitly mention such agreements in the contract to prevent potential disagreements later on.

These costs can be requested from the new employer if the employee works for another employer and not from the employee.
