Are there any regulations mandating the landlord to keep the air conditioning on?

Hello,

I’m a tenant living in Dubai in a rented apartment. During winter, the air conditioning in common areas and the ground floor lobby of my building is switched off. In summer, they are switched on but limited to 10-14 hours a day.

I have written emails to management, but they continue with the same practice.

Are there any legal clauses or regulations stating the landlord's responsibility to keep the air conditioning on?

Dear questioner,

You can file a complaint based on the terms of Article 17 of Law No. (26) of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai, which states that the landlord shall not make any alterations to the facilities provided. Before filing a case, please send a formal email to the landlord regarding the same.

Dear Questioner,

Thank you for reaching out with your concern regarding the air conditioning situation in your rented apartment in Dubai.

I understand how crucial it is to have adequate cooling, especially in a climate like ours.

In Dubai, the relationship between landlords and tenants is governed by the Dubai Rental Law, which outlines the rights and responsibilities of both parties.

While the law does not specifically mention air conditioning requirements, it does mandate that landlords must ensure that rented properties are maintained in a habitable condition and that essential services are provided.

Based on the information you've provided, it seems that the issue with the air conditioning in your building's common areas and lobby may fall under the landlord's responsibility to maintain essential services.

It's essential to address this matter promptly to ensure your comfort and well-being as a tenant.

I would recommend taking the following steps:

- Document Everything:

Keep a record of your communications with the management regarding the air conditioning issue, including emails and any responses you receive.

- Review Your Tenancy Agreement:

Check your lease agreement to see if there are any clauses related to the provision of essential services, including air conditioning. This will help you understand your rights as a tenant.

- Consultation:

I suggest scheduling a consultation to discuss your specific situation in more detail. During our consultation, we can review your tenancy agreement, assess the legal options available to you, and determine the best course of action to address the issue effectively.

Please feel free to reach out to me via WhatsApp or phone to schedule a consultation at your earliest convenience.

I am here to provide you with the legal guidance and support you need to resolve this matter.
