Is executing a judgment immediately necessary, or can I do so after 30 days?

Dear Sir/Madam,

Is execution mandatory to apply for after a court judgment, or can I apply for execution after 30 days of the judgment because I am currently out of station?

Will this create any problems for me, or will it go in favor of the other party?

Dear Inquirer,

We are pleased to serve you and address your inquiries.

After the ruling is issued in your favor and the appeal period has expired, you have the right to file an executive lawsuit to enforce the ruling.

If anything else is required, don’t hesitate to contact us via email or call our offices in Dubai or Sharjah.

Dear Questioner,

- Execution of judgment is not mandatory immediately:

Following a court judgment in the UAE, a 30-day grace period is granted to the losing party (judgment debtor) to comply with the judgment willingly.

- Right to apply for execution later:

You retain the right to apply for execution even after the 30-day window. There's no legal consequence for applying later, as long as the judgment remains valid and enforceable.

- Out-of-station status doesn't affect application:

Being out of the country doesn't hinder your ability to file for execution. You can:

  • Appoint a legal representative to act on your behalf in the UAE.
  • Potentially pursue options like remote communication with the court (depending on the specific court procedures).

However, it's crucial to note:

- Delaying execution might:

  • Potentially gives the other party more time to dispose of assets, making debt collection harder.
  • Incur additional legal fees associated with the execution process.

Dear questioner,

Even if you receive the judgment in your favor, that does not make the other party comply or obligate him to do the necessaries mentioned in the judgment.

It is only established through laws after executing the judgment so it is important to enforce the judgment to make it legal, however, you can file execution after 30 days (after the appeal period), but try to not delay execution.

If you need our assistance in filing the execution, then please share your WhatsApp number.
