The legal status of overstaying in the UAE due to a labour case

Hi Sir,

My company did not pay my final settlements till now as I resigned from August 2018.

I filed a case in MOL and I am waiting for the court judgement paper. My visa was cancelled in August and now I'm overstaying in the UAE.

Please clarify my question. If my company did not pay this overstay fine, what action do I need to take?

I want to go to my home country. I am not changing any job here.

Did you already sign the cancellation paper for the visa, before you filed the case with MOHRE?

It is important to know this fact so that we can advise you better.

If you have already signed NOC for cancellation, then it is unlikely that the company will be obliged to pay you any dues and also the overstay fines will be to your account.

Sir,

After my visa was cancelled, I waited for the money but my company did not pay.

Then I filed a complaint in MOL. They also gave time to pay but the employer failed to pay, then it was transferred to court.

It now depends on the decision of the court. You should not sign NOC before dues are paid.
