Can the company claim compensation from me if they terminate me during probation?

Hello sir

I am a 51-year-old expatriate. I have joined a company in Dubai under a limited contract and it’s been 4 months since my contract was signed.

As it seems the company is not satisfied with my performance, they have told me verbally that they don’t need my services anymore.

So I would like to check whether I may have to pay any compensation to the company for the visa expenses.

Also, if possible, let me know what will be my duration of stay in the UAE after they cancel my visa.

Please give your advice to proceed further.

Greetings,

In the United Arab Emirates, the costs of accommodation and recruitment are borne by the employer.

However, some employers stipulate in employment contracts that if the worker resigns within a period of 6 months, he will bear the accommodation costs.

And unless you resign of your own accord, you do not have to pay the accommodation costs.

You can Share your employment contract with us so that we can assist you properly.

Hence you are under probation you don't have any obligation to pay any amount to the company and if you are joining another company then your new employer may compensate for the recruitment expenses incurred by the current employer.

And you will be entitled to have a grace period minimum of 30 days after visa cancelation.

According to the law, you are not obligated to compensate them at any point in time, whether it is you or them who terminated the contract.

As for your visa cancellation inquiry, the grace period to leave the country is usually up to 6 months depending on your visa category and/or your profession.

Dear User,

As per UAE Labor Law, the employer is prohibited from charging the employee for recruitment fees, and the duration of your grace period depends on your visa category.
