How and when do I get paid after getting a labor judgement in my favor?

Dear respectable Legal experts,

I have a question:

I filed a case against my employer for my salary, gratuity, and annual leave and it took 6 months until the case judgment came in my favor.

During these months, I could not get a job due to the legal case as other employers were reluctant to offer me a job.

Please advise as per the UAE Labor Law. Do I have the right to claim any housing allowance or basic salary any compensation?

As you know, it is very difficult to survive without a job in Dubai and if you are also living with your family and kids going to school.

He even terminated my family medical insurance which my employer provided up to my last day of employment as per my contract.

Kindly advise,

Thank you.

Dear Questioner

You can ask for additional compensation for the losses you are bearing due to the case and complications made by your ex-employer.

You need to submit a request to the court and mention your liabilities in the request. If the court is convinced then you will receive compensation.

If you need further clarification, please share your Whatsapp number.

Dear Questioner,

Thanks for your inquiry.

Regarding the above, we would like to inform you that, according to the UAE Labor Law, an employee has the right to claim compensation for any damages suffered as a result of the employer's violation of the law.

This includes any financial losses incurred due to the delay in receiving salary or gratuity, as well as any loss of benefits such as housing allowance or medical insurance.

In your case, it is advisable to consult with a legal expert or approach the Ministry of Human Resources and Emiratization to file a complaint and claim for compensation.

The amount of compensation will depend on the specific circumstances of your case and the decision of the court.

It is also important to note that employers are required to provide medical insurance for their employees and their families, even after termination of employment.

If your employer has terminated your family's medical insurance without a valid reason, you may also have a case for compensation.

We can help you on your matter by appointing us as your lawyer in order to take the necessary steps to protect your rights as an employee in the UAE.

Please feel free to contact us by phone or email.

Regards,

If the reason for termination of the employment contract by the employer was without prior warning, you are also entitled to the warning allowance.

You have no right to. The employer is not responsible for the delay of the case or the fact that you did not get a job.
