Holding visa cancellation after expiry due to a pending loan

Hi,

My name is Hammad.

I was working with an event agency as a graphic designer, my visa expired on 23 Nov 2018 and my company is not cancelling my visa.

They took my passport for cancelling and now they are not responding to my emails and my Whatsapp messages.

What should I do?

Dear Hammad,

Can you please clarify if your contract was a limited contract or unlimited contract?

Did you take any loan from the company? Do you have any debts?

Did you receive the last salary and the end of service gratuity?

However, you should have sent them a notice letter that you don't want to continue the employment (if your contract was a limited one) or your resignation (in case of unlimited contract).

In case you followed the labour contract instructions and you have sent them the notice or the resignation, they have the obligation to cancel your visa (a process that takes a maximum of 5 days).

They are not allowed to keep your original passport.

I suggest you to hire a lawyer, to send them a legal notice to cancel your visa and return your passport.

Hi Raluca

First of all, thank you very much for your response.

My contract is unlimited.

Yes, I took a loan from my company and I gave my wife's security cheque against that loan as well and they are deducting 1000 AED from my salary every month.

But now they bounced the cheque and filed a police case against it without informing us.

No service gratuity. I already put labour complaint yesterday and I got the message to visit tomorrow for complaint request.

I need some guidelines to deal with this case and want to discuss some personal discussion as well.

If you can provide me with your contact number that will be easy for me.
