Three months' salary as compensation—do I work during this period?

Dear Sir/Madam,

I got terminated from my company, and they said they will compensate me for three months of my salary, but I have to work there until April, so it’s my salary, not compensation.

Dear Questioner,

You need to check the terms and conditions of the contract.

If you feel there is any breach of contract or your rights were violated, you can complain to MOHRE.

Dear Questioner,

Please go through your termination letter, if the termination is due to redundancy, then you are not eligible for compensation.

Also if it is possible, review the employment contract to find the compensation terms whether mentioned there or not.

If the termination was not your fault and not a redundancy, then you can claim the compensation.

Dear Sir,

It is our understanding that the employer terminated the contract with a contractual three-month notice period.

Accordingly, it is up to the company's discretion to have the employee serve the three-month notice period or waive the service.

Nevertheless, the employer will be required to compensate for the notice period.

Dear Questioner,

Yes, if the reasons for termination are coming under illegal termination according to the UAE employment contract, then you can claim three-month compensation which is not according to the above-mentioned process.

This is not considered compensation, this is a normal salary-receiving procedure. If they deviate from the labor law, you can file a complaint with the MOHRE.

If you need further clarification regarding illegal termination, we will arrange a legal consultation session.

Share your WhatsApp number if you want to proceed.

Dear Client,

Thanks for your question! I hope you are doing well. I will assist you in this matter.

If your employer terminated your employment but offered three months' salary as compensation with the condition that you work until April, ensure you clarify the terms with your employer in writing.

Compensation is typically separate from your regular salary and is provided upon termination.

Review your employment contract, consult with us if needed, and document all communication to protect your rights and ensure compliance with UAE labor laws.

For any further legal assistance, you can WhatsApp us. We have an extensive team of knowledgeable and experienced lawyers to provide the legal assistance you need.

We will be happy to help you.

Thanks & Regards,

ABDUL WAHIED
